Partial Investment I-526E Petition Filing

A noteworthy trend observed during this period was the increased use of the partial investment filing option. Partial investments involve contributing a specific portion of the required capital, often around half, and committing to providing the remaining amount within a predefined timeframe. This option also complies with the EB-5 program’s criteria, as it signifies that the investment is “in the process of being made.” EB5AN offers this flexible pathway across all its EB-5 projects. EB5AN Rural and Urban TEA Projects at $800K

EB5AN has a variety of EB-5 investment offerings currently available to fit any prospective investors’ preferences and immigration goals. See a short description of each project below.

Kindred Resort at Keystone is structured as a secured loan investment in the construction and operation of a luxury ski-in/ski-out hotel and condominium development in Keystone, Colorado. Construction is underway, with over 1,264 jobs already created as of February 29, 2024, which is more than enough for all EB-5 investors to meet the EB-5 job creation requirement.

The project is fully capitalized, with a senior loan from Romspen and multiple institutional investors. The EB-5 loan is secured by an equity pledge and will ultimately have a first-priority senior mortgage on the property.

Twin Lakes Georgia is structured as a secured debt investment in the construction and development of a 1,300 single-family home community in Hoschton, Georgia. Construction is underway, with over 490 homes fully constructed and delivered to buyers as of March 31, 2024. The project has created over 3,100 jobs as of February 29, 2024. USCIS has approved the I-956F exemplar applications for multiple phases of Twin Lakes Georgia. This means the project has been found to be EB-5 compliant, further reducing risk to EB-5 investors.

The project is also fully capitalized, with a senior loan from Third Coast Bank in place. The EB-5 loan is secured by a repayment guaranty from a diversified Kolter parent company. The entire balance of the loan is secured by this company’s substantial assets and net equity.

Wohali Utah is a single-family home and golf community development located just north of Park City, Utah. Situated on over 5,000 acres of beautiful land in the mountains of Utah, Wohali Utah consists of 428 single-family homes, an 18-hole championship golf course, and a host of other community amenities. Construction is well underway, with the golf course nearly completed and the clubhouse and infrastructure under construction. USCIS has approved the I-956F exemplar application for Wohali Utah. This means the project has been found to be EB-5 compliant, further reducing risk to EB-5 investors.

As of December 31, 2023, Wohali Utah has created over 690 qualifying EB-5 jobs, enough to immediately satisfy the job creation requirements for the first 69 EB-5 investors who join the project. In total, the project is expected to create 4,396 jobs.

Wohali Utah is financed in part by a senior loan from a national lender, and the EB-5 loan is secured by first and second mortgages on thousands of acres of land and a 100% developer equity ownership pledge.

Boynton Beach Multifamily (Equity) is structured as an equity investment with a preferred return. The investment will partially finance the construction and operation of a 210-unit apartment complex for active adults aged 55 and older. The project is strategically located in Boynton Beach, Florida, where a large percentage of the population is older and affluent. The project faces limited existing or planned nearby competition.

This compelling urban targeted employment area (TEA) project features a shorter target investment duration of 3.75 years. It also offers EB-5 investors a higher 5.0% annual preferred return.

The investment will partially finance the construction and operation of a 210-unit apartment complex for active adults aged 55 and older. The project is strategically located in Boynton Beach, Florida, where a large percentage of the population is older and affluent. The project faces limited existing or planned nearby competition.

This compelling urban TEA project features a loan with a shorter three-year term. It also offers EB-5 investors excellent investment security, with a repayment guaranty on the loan from a diversified, well-capitalized Kolter parent company.
