What Is the EB-5 Visa?
The EB-5 visa, formally known as the EB-5 Immigrant Investor Program, is a visa category for foreign investors. Despite being employment-based, its primary purpose is to attract foreign capital to stimulate the American economy and create jobs for American workers.
Created by Congress in 1990, the EB-5 program grants foreign nationals and their families permanent residency in the United States in exchange for a qualifying investment. The minimum investment is currently set at $800,000 for projects in targeted employment areas (TEAs) and $1,050,000 for those in non-TEA regions.
To be eligible, the investment must be made in a new commercial enterprise that creates at least 10 full-time jobs for U.S. workers. All funds must be sourced legally, and investors must provide documentary evidence to prove this to be the case.
