EB-5 Investor in EB5AN’s Twin Lakes Project Gets Employment Authorization & Travel Permit in Only 60 Days

EB5AN’s Twin Lakes project recently celebrated a major milestone for one of its investors. Sid Sinha was granted his employment authorization document (EAD) and travel permit just 60 days after filing the required forms. Usually, it takes more than nine months to get approved for a travel permit.

Since Sid was already in the United States, he was able to file Form I-526E and concurrently adjust his status with a Form I-485 submission.

And Sid is not alone. Another investor in Twin Lakes recently received an EAD in just 88 days.

These outcomes show that investing in EB5AN’s projects offers a quick way to get travel and work authorization. Through EB-5 investment, foreign nationals already living in the United States can begin to work and travel sooner than they might think.

In this article, we share some highlights from Sid’s story. We then discuss how the EB-5 program offers a faster immigration solution for foreign nationals in the United States on non-immigrant visas. We describe the process for quickly getting work and travel permits through an EB-5 investment. Next, we discuss how EB-5 investments are currently a great option for Chinese and Indian investors. And finally, we share how we can help you live and work in the United States through an EB-5 investment in a high-quality, low-risk project.

EB-5 Investor Sid Sinha Received Work and Travel Permits in 60 Days

We recently featured Sid in our investor interview series. We invite you to watch his episode and find out why he chose the EB-5 immigration path. Sid explains how the slow H-1B and EB-2 visa process motivated him to look for a faster option.

“My immigration lawyer and the team at EB5AN told me that I could get work authorization much faster through an EB-5 investment. But I didn’t expect it to be this quick. I’m very pleased to be able to work and travel freely in and out of the U.S. while I wait for my EB-5 Green Card.”

In the following video, Sid talks about what it means to him to get his work and travel permit in such a short time:

Hi, my name is Sid Sinha, and I’m an EB-5 investor in the EB5AN and Kolter Twin Lakes project. My wife and I invested in the first week of March 2023. Our attorney Anahita George, along with the I-526E application, also concurrently filed for adjustment of status, which means that we were able to file for a work authorization document and a travel authorization document. Like I said, this was done in the first week of March, but just a couple of days ago, around May 10th, we got a lot of mail from USCIS. We weren’t sure what these were for, but when we opened them, we were really pleasantly surprised that we received approvals for both our work permit and our travel document—barely 60 days after the investment.

I cannot begin to express how relieved I am with these approvals in hand because this will obviously give me and my wife flexibility and expanded career opportunities and allow us to travel overseas without any delay. I was always under the impression that the work authorization takes about 4 to 5 months to come through, and the travel authorization takes about 9 to 12 months. But, like I said, this was a really, really pleasant surprise. So, I just wanted to thank Sam and Mike from EB5AN and our attorney and Anahita George for all the help. Thank you.

Get Work and Travel Authorization in a Matter of Days through an EB-5 Investment

In the past, the EB-5 investment process has been known for its slow investor application processing times and backlogs.

The EB-5 Reform and Integrity Act of 2022 (RIA) has given investors new options. Under the RIA, investors already in the United States can now apply for their work and travel documents when they file their EB-5 application. This filing option greatly speeds up the work and travel authorization process.

When a foreign national invests in an EB-5 project, the first step is to file Form I-526E. This application informs U.S. Citizenship and Immigration Services (USCIS) of the investor’s desire to obtain a visa through an EB-5 investment.

The RIA now allows investors to submit both Form I-526E and Form I-485 simultaneously. (Form I-485 is the application non-immigrant visa holders use to adjust their immigration status.)

This change has streamlined the process, enabling investors to change their immigration status to “pending” and apply for an EAD. Once they get an EAD—sometimes in a matter of days—this allows them to work legally in the U.S. while their Green Card application is being processed.

After submitting both applications, an investor can also apply for a travel permit.

The EB-5 Program Offers a Fast Solution for Changing Immigration Status

Non-immigrant visas often limit what the visa holder can do. These can include restrictions on work and travel.

The EB-5 visa has become more and more popular as an alternative to more restrictive visas. Many H-1B and E-2 visa holders are pursuing EB-5 visas to help avoid the limitations they face.

For example, an H-1B visa worker can work in only a specific sector. He or she also needs employer sponsorship. If an H-1B visa holder loses his or her job, he or she must quickly find another sponsor or leave the United States.

But foreign nationals who file their I-526E and I-485 petitions at the same time can have these limitations removed. EB-5 applicants living in the United States can quickly obtain work authorization. Then they can work where they want without worrying about employer sponsorship.

Anahita George, Sid’s immigration attorney, noted that “Concurrent filing through an EB-5 visa application is a new—and unprecedented—opportunity for immigrant investors. They can get an EAD in just days. These opportunities are very rare in U.S. immigration programs, and I would encourage those in the U.S. on H-1B, E-2, F-1, and similar visas to seriously consider this option. You can essentially start to enjoy many of the benefits of permanent residency in a matter of days.”

The EB-5 Program Is Currently a Great Option for Indian and Chinese Visa Holders

Chinese and Indian nationals make up a large part of those working in the United States on H-1B visas. Until recently, the EB-5 visa was not a great option for them due to massive application backlogs.

Under the RIA, though, this dynamic has changed. The RIA offers a solution for Chinese and Indian nationals to avoid long waits: set-aside EB-5 visas. These visas are reserved for investors in high-unemployment projects and rural projects like Twin Lakes.

Investing in these kinds of projects allows Chinese and Indian investors to avoid long processing times. Only a limited number of these set-aside visas are available each year. So far, that limit has not been reached. But investors who are interested should take advantage of this opportunity while they can.

Sid invested in the Twin Lakes project, which is in a rural TEA. As a result, he was eligible for one of these set-aside visas. This allowed him to change his immigration status right away.

Consider Investing in Twin Lakes, a Low-Risk Rural EB-5 Project

Twin Lakes is a 1,300-unit single-family home community for active adults. The project is in rural Georgia, near Atlanta.

Even with interest rates on the rise in 2023, Twin Lakes has already sold more than 500 homes. Home sales to date represent more than $200 million in revenue. The project has also been approved for third-party construction financing by both Wells Fargo Bank and Third Coast Bank.

The Kolter Group is one of the largest private developers in the United States. Kolter has more than $24 billion of development experience, including more than 20,000 single-family homes. Since 1997, Kolter has never failed to complete a project or repay a loan.

Much of the infrastructure for Twin Lakes is in place. All main amenities have already been built. And several hundred homes are complete, with many more under construction.

Progress on the project is essential for EB-5 investors to meet the job-creation requirements of the EB-5 program. Twin Lakes has already created all the necessary jobs for its EB-5 investors. Since this is the main requirement for EB-5 investors to get their Green Cards, the project’s immigration risk is minimal.

Because the project is in a rural TEA, its investors qualify for set-aside EB-5 visas. This makes Twin Lakes a great option for Chinese and Indian nationals who want to avoid the long waits of standard EB-5 visas. Rural TEA designation also qualifies investors for priority processing for Form I-526E

EB5AN’s main goal is to help investors immigrate through the EB-5 program and protect their invested capital. Sid’s positive experience of quickly getting his EAD, and the similar experiences of other EB5AN investors, shows how EB5AN is meeting the clear demand for high-quality rural EB-5 projects. EB5AN believes its focus on transparency and excellence offers one of the safest ways for EB-5 investors to quickly get their work and travel permits.
