Kindred Resort at Keystone Creates All Required Jobs for All EB-5 Investors

Kindred Resort at Keystone, a rural EB-5 project, has created all the required jobs for its EB-5 investors to receive U.S. Green Cards. Now, current, and future EB-5 investors in Kindred can rest assured that they will fulfill the main requirement for immigrating through the EB-5 program.

Kindred will comprise 95 condominium units, a 107-room 4-star hotel, 25,000 sq. ft. of retail space, and a private ski club. The project has already generated significant revenue through condominium sales and features a secure EB-5 loan structure.

In addition to financial safety, Kindred’s rural status offers several unique immigration benefits for its EB-5 investors.

EB5AN managing partner Sam Silverman said the following: “One of the main risks of making an EB-5 investment is the possibility that your EB-5 project will not create enough jobs. Now, Kindred Resort at Keystone has eliminated this aspect of immigration risk for EB-5 investors. Our EB-5 investors can be confident that Kindred is one of the most reliable EB-5 projects for immigration and financial success.”

Kindred Resort at Keystone’s Job Creation

As of November 30, 2023, Kindred has created 1,065 jobs for its EB-5 investors, with approximately $167.6 million in construction expenditures. EB-5 job creation is calculated based primarily on construction spending.

This allows all current EB-5 investors to fulfill the job creation requirement.

In addition, future EB-5 investors in Kindred can also be credited for jobs that were created even before they joined the project. Kindred is expected to create a total of 2,334 qualifying jobs.

Project Construction Update

Construction at Kindred has already made significant strides, with notable progress on the West Tower, which will house 62 condominium units. The West Tower has been structurally topped off, with the focus shifting to interior work.

The topmost floor of the hotel structure is already being framed and is expected to be topped off soon.

In addition, the construction crew is also making progress on amenities, including the slopeside pool deck and two oversized soaking tubs between the hotel and the East Tower.

The Importance of Job Creation For EB-5 Investors

For foreign nationals who apply for EB-5 Green Cards, simply investing in an EB-5 project is not enough. Rather, USCIS requires investors to prove that their funds were used to create at least 10 jobs.

This is the foremost USCIS requirement for an EB-5 Green Card. Therefore, an EB-5 project’s safety largely depends on its existing job creation or potential to create future jobs.

Certain EB-5 projects on the market are in the early stages of construction, or may not have started construction at all. These kinds of projects have not yet created the required jobs for their EB-5 investors.

If such a project runs into financial difficulties, it may not have the capital to create sufficient EB-5 jobs. Any EB-5 investors in this project would have their USCIS petitions denied—and potentially lose their invested funds as well.

However, investing in an EB-5 project that has already created all the required jobs eliminates this aspect of immigration risk. The safest EB-5 projects have already created a significant number—if not all—of the needed EB-5 jobs.

Therefore, Kindred offers EB-5 investors a level of immigration safety that is rare in the EB-5 market.

EB-5 investors in Kindred have already taken the first step toward getting a timely approval of Form I-526E and obtaining their initial Green Cards.

Kindred Resort at Keystone: A Best-in-Class Rural EB-5 Project

Besides its significant job creation, Kindred offers a high level of financial safety and unique immigration benefits.

Financial Safety

  • As of November 2023, nearly 70% of the condominium units have been pre-sold with nonrefundable deposits of 20% of the sales cost. These presales total over $110 million in value.
  • The project does not rely on EB-5 funding for completion.
  • The EB-5 loan is secured by a 100% equity pledge in the project company. Once the senior construction loan is repaid and the hotel component of the project is complete, the EB-5 loan will record a senior mortgage on the property.
  • The above is a unique loan structure for rural EB-5 projects and increases investors’ chances of getting a timely return on their funds.
  • Any EB-5 investors whose I-526E petitions are denied will qualify for accelerated repayment.
  • Kindred’s mortgage is provided by Romspen.
  • Enhanced Capital, a major investment firm, has invested in Kindred.
  • The Keystone Ski Resort is the fourth-most visited mountain resort in the United States, making for consistent, long-term demand for both the hotel and condominium units.

Immigration Benefits

  • Priority Processing: Investors in rural EB-5 projects like Kindred qualify for priority processing of their USCIS petitions. Several investors have recently received I-526E approval in as fast as 11 months.
  • Set-Aside Visas for Chinese and Indian Investors: 20% of the total supply of EB-5 visas is set aside for investors in rural projects. This allows investors from China and India to avoid years of additional processing delays due to their country’s EB-5 backlog.
  • Concurrent Filing: EB-5 investors who already hold a U.S. non-immigrant visa can quickly adjust their immigration status and apply for an employment authorization document (EAD). A recent investor in one of EB5AN’s rural projects got an EAD in only 60 days.
