EB5AN Files Defamation Lawsuit Regarding False Statements About the Wohali Rural Project

EB5AN has filed a civil lawsuit in Florida state court against Southeast Regional Center, LLC, SRC Ajin Fund VI LLC, and SRC Investments, LLC (collectively, “SRC”), arising from alleged defamatory statements published about EB5AN and EB5AN’s Wohali Utah EB-5 project.

The lawsuit—filed by EB5AN, LLC (a Florida limited liability company), and EB5AN Wohali Utah Fund XV, LP (a Delaware limited partnership) (together, “EB5AN”)—asserts claims for defamation per se, defamation, and tortious interference with business relationships under Florida law. EB5AN is seeking damages and injunctive relief, among other remedies, as set forth in the complaint.

The Case and Where It Was Filed

The complaint is captioned as follows:

EB5AN, LLC and EB5AN Wohali Utah Fund XV, LP v. Southeast Regional Center, LLC, SRC Ajin Fund VI LLC, and SRC Investments, LLC

The case was filed in the Fifteenth Judicial Circuit in and for Palm Beach County, Florida (Case No.: 50-2025-CA-012782-XXXA-MB).

The Wohali Utah Project

The complaint describes “Wohali” as a luxury master-planned golf resort community located in Coalville, Utah.

Key allegations in the complaint include the following:

  • EB5AN, through EB5AN Wohali, raised $79.2 million from 99 foreign investors in EB-5 capital to partially fund the project.
  • The EB-5 capital was loaned to Wohali Land Estates LLC, the owner and developer of the Wohali project.
  • Construction started in approximately 2018.
  • The golf course was open for the entire 2025 season.
  • Wohali Land Estates LLC defaulted on its loan and subsequently declared bankruptcy.
  • EB5AN alleges it is the senior secured lender with a perfected first-priority lien and that EB5AN and its foreign investors are not expected to experience any loss of principal invested capital.

The WeChat Publication at Issue

According to the complaint, on or about December 1, 2025, SRC “created, authored, promoted, and published” a Chinese-language article on WeChat—referred to in the complaint as the “Maliciously Defamatory Article”—about the Wohali project.

The complaint alleges the article was published through a prominent EB-5 WeChat account, EB5Sir, which the complaint states has 79,747 followers, and that the content was positioned to maximize its spread among EB-5 investors, agents, brokers, and industry professionals.

The Statements EB5AN Disputes

The complaint alleges that “Part 02” of the WeChat article asserted numerous false statements about the Wohali Project and, by direct intended implication, EB5AN—described collectively as the “Maliciously False Statements.”

The complaint lists the following statements:

  1. Wohali is an “abandoned project” that “collapsed.”
  2. The number of jobs cannot be met.
  3. Foreign investor applicants cannot obtain a Green Card.
  4. Foreign investor applicants cannot get back their investment principal.
  5. Most of the employees of the Wohali Project have been dismissed.

EB5AN disputes these statements, and the complaint alleges they are “completely and utterly baseless and false.”

The Factual Points EB5AN Cites in the Complaint

The complaint sets out specific facts that EB5AN alleges demonstrate the falsity of the WeChat statements:

  • The Wohali golf course “was open for the entire 2025 season” and only closed temporarily for the winter season.
  • EB5AN alleges that “all the EB-5 jobs required for all 99 Wohali EB-5 investors” to obtain U.S. permanent residency under the EB-5 program “have been successfully created.”
  • EB5AN alleges that approximately 80 of the 99 EB5AN Wohali EB-5 investors have already received Form I-526E petition approval from USCIS and that many investors have already received physical temporary Green Cards.
  • EB5AN alleges that no EB-5 investors in EB5AN Wohali have realized or are expected to face a loss of investment principal.
  • The complaint states that, under the direction of the bankruptcy court–appointed trustee, the project “continues to employ team members” to maintain the golf course and operate the project.
  • The complaint alleges the Wohali project “has never been abandoned and has not collapsed.”

Claims Asserted by EB5AN

EB5AN’s complaint asserts three causes of action against SRC:

  1. Defamation Per Se (Count I)
  2. Defamation (Count II)
  3. Tortious Interference with Business Relationships (Count III)

Among other allegations, EB5AN asserts that the statements were published with malice and a deliberate intent to harm, were widely disseminated to the EB-5 marketplace, and were intended to damage EB5AN’s reputation and interfere with EB5AN’s business relationships with foreign agents, brokers, and investors.

What EB5AN Is Asking the Court to Do

In the prayer for relief, EB5AN requests that the court does the following, among other things:

  • enter a final judgment finding SRC engaged in defamation per se, defamation, and tortious interference;
  • issue a permanent injunction prohibiting SRC and related persons from publishing or distributing false statements about EB5AN and/or its projects, including the Wohali project;
  • require SRC to retract the article and statements and issue an apology through the same channels;
  • award compensatory, special, and punitive damages; and
  • grant other relief deemed just and proper.

EB5AN has also demanded a trial by jury on all issues.

EB5AN’s Position on Misinformation and Accountability

EB5AN takes the dissemination of false statements about EB5AN and its sponsored projects seriously. As alleged in the complaint, EB5AN believes these statements were made and distributed with the intent to damage EB5AN’s reputation and disrupt EB5AN’s relationships with investors and distribution partners.

The defendants named in the complaint are U.S. entities (Georgia limited liability companies). EB5AN has therefore brought this action in U.S. court and intends to pursue the legal remedies available under applicable law.
