What Is Form I-485?

Form I-485, Application to Register Permanent Residence or Adjust Status, is the immigration application a foreign national uses to apply for lawful permanent resident status in the United States. It is also known as an application for adjustment of status.

This form allows an EB-5 investor holding a non-immigrant visa to apply for U.S. permanent residency without leaving the country. EB-5 investors outside the U.S. cannot file an I-485 petition. Instead, they must file a Form DS-260 (Green Card application through consular processing).

Although an EB-5 application covers investors and their dependent family members (their spouse and unmarried children under 21), each derivative beneficiary must complete an individual I-485 application.

If the United States Citizenship and Immigration Services (USCIS) approves your I-485 petitions, you and your derivative beneficiaries will receive conditional permanent resident status. After two years of holding a conditional Green card, you can file an I-829 petition to have the conditions removed and become a full permanent resident.

When Should an EB-5 Investor File Form I-485?

Before 2022, EB-5 investors could only file for adjustment of status if an immigrant visa was available to them after receiving their I-526E immigrant petition approval. However, thanks to the EB-5 Reform and Integrity Act of 2022 (RIA), EB-5 investors can now file Form I-485 along with their I-526E petition. This is known as concurrent filing.

This change allows you and your family members to file for adjustment of status at the same time as your EB-5 petition. If you’re unable to submit an I-485 petition along with your Form I-526E, you can still submit it later while USCIS is processing your EB-5 application or after you receive approval.

  2. Invest $800,000 in the new commercial enterprise (NCE) if it is located in a TEA.
  3. Compile the relevant supporting documentation with the help of an experienced immigration attorney.
  4. Concurrently file Forms I-526E, I-485, EAD and AP, and pay all associated fees.
  5. Receive receipt notice.
  6. Attend your USCIS biometrics appointment and interview (unless waived).

  9. File Form I-829 to remove the conditions.
