EB-5 means employment-based fifth preference. Although classified under employment-based visas, the EB-5 visa is an investor visa. It is officially termed the EB-5 Immigrant Investor Program.
The EB-5 program was introduced by Congress in 1990 to attract foreign investments to the U.S. to bolster the American economy and create jobs for American workers. It grants foreign investors and their dependents permanent residency in exchange for their investment in the U.S. economy.
The minimum required investment amount for an EB-5 visa has changed over the years. Currently, it stands $800,000 for investments in targeted employment areas, and $1,050,000 for investments in non-TEA regions. To qualify, foreign nationals must invest in a new commercial enterprise (NCE) that will create at least 10 full-time jobs for American workers.
In addition to investing the required amount, investors must provide documentary evidence that they legally obtained the invested funds.
