Multiple Chinese Investors in EB5AN’s Twin Lakes Project Receive Physical Green Cards—In As Fast As 10 Months

We are pleased to announce that two more investors in EB5AN’s Twin Lakes Georgia rural EB-5 project have received their physical U.S. Green Cards.

Both investors are Chinese nationals. One investor received her Green Card 14 months after filing Form I-526E.

The other investor received her Green Card only 10 months after filing her I-526E petition.

As EB5AN announced previously, an Indian national who invested in Twin Lakes has received his Green Card as well.

Now that they hold their U.S. Green Cards, these investors can live and work in the United States as permanent residents. With few restrictions, they can travel internationally in and out of the country.

Their visa status no longer depends on their employment, studies, or other common requirements for non-immigrant visas like the H-1B visa.

The EB-5 program allows an investor’s dependent family members—their spouse and children under 21—to obtain Green Cards as well.

In this post, we explain how EB-5 investors can potentially get Green Cards in a matter of months by investing in a rural EB-5 project.

Two More Twin Lakes Investors Have Physical Green Cards in Hand

Our first investor in the Twin Lakes project filed her I-526E petition on April 26, 2023. The I-526E petition was approved approximately 13 months later, on June 6, 2024.

This investor received her Green Card on June 26, 2024—14 months after filing Form I-526E.

The second investor filed Form I-526E on September 13, 2023. Her I-526E submission was approved in about 9.5 months, on June 26, 2024.

This investor received her Green Card on July 12, 2024—less than 10 months after filing Form I-526E.

As mentioned previously, both investors already hold their physical Green Cards and enjoy the benefits of permanent resident status.

Our investors previously held non-immigrant U.S. visas and filed Form I-485 to adjust their immigrant status. Both received their I-485 approvals and their Green Cards on the same date.

Instead of filing Form I-485, investors who live outside the United States must schedule a consular interview to receive their Green Cards after I-526E approval.

Benefits of Holding a U.S. Green Card

The initial Green Cards EB-5 investors receive are valid for only two years. At the end of the two-year period, an EB-5 investor files Form I-829 to remove the conditions on their Green Card.

While USCIS processes Form I-829, EB-5 investors can have their Green Cards renewed.

This means that, once they receive their initial Green Cards, EB-5 investors can potentially continue to enjoy permanent resident status until Form I-829 is approved. EB-5 investors will not have to leave the country or rely on employer sponsorship during this period.

In contrast, most non-immigrant visas require applicants to have employer sponsorship, study continuously, or fulfill other criteria. H-1B workers, for instance, may have to leave the United States in a matter of days if they are laid off.

Other non-immigrant visas include the F-1, E-2, and TN categories.

EB-5 investors who receive their Green Cards can choose to work for any employer, work part-time, start a business, or not work at all. They can also travel internationally with fewer restrictions.

The EB-5 program is likely the fastest way for foreign nationals to get U.S. Green Cards and avoid relying on a non-immigrant visa.

Invest in a Rural EB-5 Project—Potentially Get U.S. Green Cards in Only Months

Historically, average wait times for EB-5 investors have been significantly longer than the recent approvals for our investors in the Twin Lakes project.

Investors from countries with a high demand for EB-5 immigration—especially China and India—sometimes had to wait for multiple years before receiving their Green Cards.

Now, investors in rural EB-5 projects are often receiving their Green Cards much faster, even if their nationality is Chinese or Indian.

The EB-5 Reform and Integrity Act of 2022 (the RIA) introduced a new benefit for all investors in rural EB-5 projects, regardless of their nationality: priority processing.

Investors in rural projects are seeing significantly faster processing times for their USCIS petitions. Across the EB-5 industry, many investors in rural projects are receiving I-526E approvals in about 12 months—or even less.

Besides priority processing, Chinese and Indian nationals have a further incentive to choose rural EB-5 projects.

Both China and India currently have a backlog of EB-5 applications, and investors from these countries normally have to wait for additional months or years before receiving their Green Cards.

The RIA created special categories of set-aside visas for both rural and urban EB-5 projects. Chinese and Indian investors who get a set-aside visa can avoid these additional delays to get their Green Cards.

The set-aside visa category for rural EB-5 projects gets 20% of the total yearly supply of EB-5 visas. In contrast, urban EB-5 projects only get 10%, and the supply of urban set-aside visas is likely to enter a backlog soon.

Therefore, investing in a rural EB-5 project is the safest way for Chinese and Indian investors to avoid additional delays before receiving their Green Cards.

In addition to faster immigration, EB-5 investors who hold non-immigrant visas can also receive employment authorization documents (EADs) and advance parole (AP) travel documents in a matter of days.

These documents allow investors to work and travel internationally even before they receive their Green Cards.
