We are pleased to announce that an EB-5 investor in Grand Park, EB5AN’s rural EB-5 project in Colorado, has received the project’s first Form I-526E approval in only 10.7 months.
With this approval secured in less than 12 months, the EB-5 investor and their eligible dependent family members can move forward toward U.S. Green Cards.
For EB-5 investors and their families considering the Grand Park EB-5 project, this is welcome news. USCIS has already approved Grand Park’s project documentation through Form I-956F. Now the project has its first individual Form I-526E approval, received in months rather than years.
“Grand Park’s first I-526E approval in only 10.7 months is excellent news for our EB-5 investors,” says Sam Silverman, managing partner of EB5AN. “USCIS has already approved Grand Park’s project documents, and now it has approved an individual EB-5 investor’s petition. New EB-5 investors can choose Grand Park knowing that both stages of USCIS review have been completed successfully. That reduces project-related immigration risk and gives them greater confidence in their own I-526E filings.”
Grand Park combines active construction near Winter Park Resort with a secured senior loan, substantial collateral, and rural priority processing. With its first I-526E approval now secured, we expect Grand Park to become one of the premier EB-5 projects for EB-5 investors seeking both immigration security and financial safety.

An I-526E Approval in Less Than 12 Months
The first I-526E approval in an EB-5 project is a strong indicator of its ability to support successful petitions for future EB-5 investors. USCIS has accepted the project documents in an individual EB-5 case and approved that EB-5 investor’s eligibility. At Grand Park, this first approval took only 10.7 months.
That is particularly encouraging as I-526E processing times have been rising in 2026. As reported in EB5AN’s analysis of FY2026 Q3 data, the median processing time increased from 11.7 months in Q2 to 13.6 months in Q3. Pending I-526E petitions reached 11,192 at the end of June.
Grand Park’s 10.7-month approval was faster than that reported median and comfortably within 12 months. The figure includes completed I-526E cases across categories, including rural and nonrural projects.
Grand Park’s result shows that an EB-5 investor in an approved rural project can still receive I-526E approval within a year despite longer processing times across the program.
The approved EB-5 investor and their eligible dependents can now proceed toward conditional permanent residence through consular processing abroad or adjustment of status in the United States. Once that step is completed, they may receive Green Cards allowing them to live, work, and study in the United States as permanent residents.
Grand Park has already delivered a successful I-526E result in less than a year, giving new EB-5 applicants a concrete reason to trust this project.
Grand Park: A Mountain Community Taking Shape
Grand Park is a master-planned community in Fraser, in Colorado’s Grand County, adjacent to Winter Park Resort. Residents and visitors have access to skiing, mountain biking, hiking, and other outdoor recreation throughout the year, within driving distance of Denver.
EB-5 financing supports continued development within this established mountain community. Grand Park brings together homes for sale, long-term rental apartments, lodging, commercial space, and recreational amenities. Its combination of residential neighborhoods, businesses, and visitor accommodations supports both year-round living and tourism in the Fraser Valley.
Grand Park’s development plans include approximately 220 residential lots, 319 vertical residential units, 125 vertical lodging units, and lodging pad sites supporting another 450 units. Plans also include more than 70,000 square feet of commercial space, new roads and utilities, and a golf course and clubhouse.
The Grand Park development team brings more than 80 years of combined real estate experience. Its local work includes five subdivisions and nearly 400 homes in the Fraser Valley. The team has spent years building in this market and has experience with the local demand, infrastructure, and construction conditions involved in delivering mountain communities.
Grand Park has also closed more than 260 home sales totaling over $190 million since 2007. Those completed sales demonstrate that buyers are already choosing the community, giving EB-5 investors a sales history to examine as development continues.
Construction Continues Across Several Sites
The Grand Park September 2026 construction update showcases work across the project’s infrastructure, residential, and commercial areas. Water services are being brought into Filing 1, and sewer work is advancing along Grand Park Drive. At Market Street, crews are completing exterior finishes and preparing for interior work.
At The Mill Apartments, exterior work on the 36-unit building is nearing completion, while cabinets, trim, and doors are being installed in the 24-unit building. The update also confirms that slab preparation at The Ascent is complete, with concrete placement scheduled.
This construction spending helps generate the qualifying jobs Grand Park’s EB-5 investors need for their Green Cards. Regular construction reports also let EB-5 investors follow the work funded by their investment and compare completed work with the development schedule.
Why Grand Park’s First I-526E Approval Reduces Immigration Risk
Grand Park has now received two separate USCIS approvals: Form I-956F approval for the EB-5 project and Form I-526E approval for its first individual EB-5 investor. Together, these approvals give future EB-5 investors stronger evidence that Grand Park can support their immigration plans.
USCIS Has Already Reviewed Grand Park’s Project Documents
Grand Park’s Form I-956F exemplar approval confirms that USCIS has reviewed and accepted its project documentation for EB-5 compliance. This includes the business plan, investment structure, economic analysis, and evidence supporting the rural targeted employment area designation.
This is a substantial benefit for a new EB-5 investor in Grand Park. In an EB-5 project without I-956F approval, USCIS may still question whether the investment structure or proposed job creation meets program requirements. Any unresolved project issues can delay the I-526E petitions of all EB-5 investors in that project.
Grand Park’s EB-5 investors already have USCIS approval of these project documents. EB5AN’s experience obtaining I-956F approval for rural EB-5 projects helps us structure investments and prepare documents that meet USCIS requirements before individual I-526E petitions are adjudicated.
Under USCIS policy on project applications, I-956F approval is generally binding when USCIS adjudicates associated EB-5 investor petitions, subject to specified exceptions.
USCIS can generally rely on its prior I-956F project approval when reviewing subsequent I-526E petitions.
The First I-526E Approval Gives Future EB-5 Investors Stronger Evidence of Success
Future EB-5 investors in Grand Park now have stronger evidence of immigration success through an actual I-526E approval, alongside the approved I-956F project application. Grand Park’s EB-5 documentation has supported both a successful project application and a successful individual I-526E petition.
This I-526E approval reflects EB5AN’s careful project structuring and compliant investment documents. Grand Park has passed USCIS project review, and its first EB-5 investor has received I-526E approval. Future EB-5 applicants can invest with greater confidence that the project-related requirements have already been reviewed and accepted.
For a prospective EB-5 investor, this is an important reason to favor an EB-5 project with I-526E approvals already in hand. Combined with approved project documentation, an existing I-526E approval reduces uncertainty about whether the project can support successful EB-5 petitions.
With satisfactory source-of-funds evidence and personal eligibility, new EB-5 investors in Grand Park have good reason to expect successful, timely I-526E adjudications. Each petition still receives an individual review, but USCIS has already accepted the Grand Park project documents on which those petitions depend.
Rural EB-5 Benefits Support a Faster Path
Grand Park qualifies as a rural targeted employment area, or TEA. Under the current investment thresholds, EB-5 investors can qualify with an $800,000 investment, compared with $1,050,000 for a project outside a TEA.
Rural EB-5 investors also qualify for priority processing of their I-526E petitions. This statutory benefit has made rural EB-5 investments attractive to EB-5 investors and their families seeking a faster immigration process.
Grand Park’s first approval in 10.7 months demonstrates that its rural EB-5 investors can receive I-526E approvals in only months, not years.
Another benefit is access to the rural visa category, which receives 20% of the annual EB-5 visa allocation. For EB-5 investors born in China or India, this separate allocation can substantially shorten the wait for a Green Card when rural visas are available.
A Senior Loan With Several EB-5 Investor Protections
Grand Park’s first I-526E approval adds immigration security to a project already structured with several financial protections. EB-5 capital is provided through a secured senior loan, backed by a first-priority deed of trust and a 100% equity pledge in the project company.
Collateral and an Individual Four-Year Term
The senior loan takes priority over equity in the borrower’s payment structure. The collateral gives the lender assets against which it can enforce its rights under the loan documents, providing additional protection if the borrower fails to meet its obligations.
Grand Park also provides an individual four-year loan term for each EB-5 investor, independent of other EB-5 investors’ terms. Each participant’s term runs separately, so it is not tied to when other EB-5 investors join the project. Repayment remains subject to the loan documents and the borrower’s ability to repay.
Completion, Refund, and Job Creation Guaranties
The developer provides a construction completion guaranty covering portions of Grand Park commenced with EB-5 loan proceeds. This creates a contractual obligation to complete the work funded by the EB-5 loan.
An I-526E approval refund guaranty provides for the return of an EB-5 investor’s capital following an I-526E denial, subject to the guaranty’s terms. A separate job creation guaranty addresses the use of EB-5 funds for qualified project costs and the creation of at least 10 qualifying jobs per EB-5 investor.
These guaranties give Grand Park’s EB-5 investors contractual protections covering construction, petition denial, and job creation. EB-5 investors should review the guaranties’ terms and the guarantor’s ability to perform with their advisors, alongside the loan’s collateral and repayment provisions.
Grand Park Is Already Creating Qualifying EB-5 Jobs
Grand Park has already created more than 400 qualifying EB-5 jobs as construction continues. The project is expected to generate approximately 2,630 EB-5-eligible jobs overall, substantially more than required for its planned EB-5 investors.
These jobs support immigration success beyond the I-526E stage. Grand Park’s EB-5 investors will later need evidence of qualifying employment for their I-829 petitions to remove the conditions on their permanent residence. Jobs already created reduce their dependence on future construction spending to meet that requirement.
