Multiple I-526E Approvals Within 12 Months for EB-5 Investors in Twin Lakes Rural EB-5 Project—Fastest Approval in Only ~9.5 Months

In the past, EB-5 investors have typically had to wait for several years before receiving approval for Form I-526E. This application allows EB-5 investors to receive their conditional U.S. Green Cards.

However, under the EB-5 Reform and Integrity Act of 2022 (the RIA), EB-5 investors in rural projects are experiencing much faster processing times for their I-526E petitions.

EB5AN is pleased to announce that multiple investors in our Twin Lakes Georgia rural EB-5 project have received I-526E approvals in approximately 12 months.

The fastest I-526E approval in Twin Lakes so far took only about 9.5 months.

These EB-5 investors are now eligible for their conditional Green Cards, which allow them to live and work anywhere in the United States with their family members, as well as travel internationally with few restrictions.

“Receiving approval for Form I-526E in about 12 months—or even 9.5 months—is a remarkably fast processing time,” notes Sam Silverman, managing partner of EB5AN.

“Getting their initial Green Cards in a matter of months opens up a wealth of career and academic opportunities for our EB-5 investors. We encourage anyone interested in relocating to the United States to explore investing in a rural EB-5 project like Twin Lakes Georgia. You could potentially enjoy the benefits of permanent residency in only months.”

Fast I-526E Approvals for Twin Lakes Georgia’s EB-5 Investors

EB5AN’s Twin Lakes Georgia project has achieved multiple I-526E approvals for its investors.

With the fastest approval coming in only about 9.5 months, these processing times are significantly faster than the historical average for the EB-5 program.

Below are the USCIS approval notices for the investor who was approved in about 9.5 months.

Benefits of U.S. Green Cards Through the EB-5 Program

After receiving approval for Form I-526E, EB-5 investors who live outside the United States can get their initial Green Cards after a consulate interview. For EB-5 investors who already live in the United States under a non-immigrant visa, their I-485 application for adjustment of status is then approved, granting them Green Cards.

Even though an EB-5 investor’s initial Green Cards are conditional—until Form I-829 is approved later on—they can already enjoy the benefits of permanent residency.

Once they receive their Green Cards, EB-5 investors can:

  • Live anywhere in the United States.
  • Enjoy unlimited employment opportunities, choosing to work at any company, work part-time, or start a business.
  • Pursue academic degrees without any restrictions on employment.
  • Enroll their children in public schools and enjoy a higher admission rate for U.S. colleges and universities.
  • Travel internationally with few restrictions.
  • Enjoy a higher quality of life and the United States’ political and economic stability.

Many investors pursue the EB-5 program in search of these immigration benefits.

EB-5 Investor Interview—How I’m Benefitting From My EB-5 Green Card

Many EB-5 investors already live in the United States on a non-immigrant visa—such as an H-1B or E-2. These visas impose many restrictions on work, study, and travel.

To break free of these limitations, many non-immigrant visa holders are turning to the EB-5 program as a quick way to enjoy the benefits of being a permanent resident.

Milan, an H-1B visa worker from India who invested in EB5AN’s Twin Lakes project, explains how the H-1B visa’s restrictions motivated him to consider the EB-5 program: “The main reason for doing EB-5 is that I want to get out of renewing my H-1B visa every three years. It was very inconvenient and I would have to put stress on family to do that process.”

“Another reason,” Milan continues, “is for my son’s studies. He wants to pursue the medical domain. And for him to get admission into colleges is almost impossible if we are not citizens or permanent residents here.”

After investing in the Twin Lakes project, Milan received I-526E approval for his initial U.S. Green Card in about 11 months.

Get U.S. Work and Travel Authorization in A Matter of Days

Faster I-562E approvals are not the only new benefit for EB-5 investors under the RIA.

EB-5 investors who hold a non-immigrant U.S. visa—such as an H-1B, F-1, E-2, TN, O-1, or L-1—may be able to get work and travel authorization in a matter of days.

EB-5 investors who hold the above visas can apply for an employment authorization document (EAD) and advance parole (AP) at the same time as submitting Form I-526E. This process is known as concurrent filing.

An EAD and AP allow EB-5 investors to work freely in the United States without employer sponsorship and to travel internationally.

In addition to the multiple fast I-526E approvals, investors in the Twin Lakes projects have also gotten quick EAD and AP approvals.

The fastest EAD and AP approval took only 33 days for a recent Twin Lakes investor.

Investors in Rural EB-5 Projects Qualify for Priority Processing and Set-Aside Visas

If I-526E processing times have historically taken many years, why are so many Twin Lakes investors receiving approvals in a matter of months?

The answer lies in the RIA’s incentives to invest in rural EB-5 projects. Investors in rural EB-5 projects now qualify for priority processing of their USCIS petitions.

Throughout the EB-5 industry, we are now seeing significantly faster I-526E approvals for investors in rural projects.

In addition, Chinese and Indian investors can now avoid their country’s EB-5 visa backlog by investing in a rural EB-5 project.

Instead of waiting for many years for their Green Cards, Chinese and Indian investors can now get their I-526Es approved in a matter of months.

It is important to note that Chinese and Indian investors must invest in a rural project to qualify for priority processing, set-aside visas and concurrent filing.

(While investors in high-unemployment projects also qualify for set-aside visas, this project category’s visa supply is already backlogged according to recent USCIS data.)
