Investors in EB5AN’s Twin Lakes Project Continue to Receive U.S. Green Cards—Now in Only 9 Months

We are pleased to announce that another investor in our Twin Lakes rural EB-5 project has received a U.S. Green Card—approximately 9 months after filing Form I-526E. Our investor, a Chinese national, can now live and work in the United States as a permanent resident—without relying on employer sponsorship or other conditions.

This is the fastest Green Card issuance so far for investors in our Twin Lakes project.

With this latest Green Card issuance, Twin Lakes continues to be one of the most successful rural projects on the EB-5 market. As we reported previously, multiple Chinese and Indian investors in Twin Lakes, along with their families, are already enjoying their U.S. Green Cards.

Twin Lakes Investor Receives Green Card in 9 Months

Our investor filed their I-526E petition on October 19, 2023.

Form I-526E is the first USCIS application in the EB-5 process. Along with this form, investors must submit documentary evidence that their funds were sourced lawfully. They must also show that the funds are irrevocably invested and that the EB-5 project complies with USCIS policies.

Once USCIS approves an investor’s I-526E submission, the investor and their family can receive their U.S. Green Cards. These initial Green Cards are typically valid until the investor’s I-829 submission is adjudicated. If an investor’s Form I-829 is approved, then their conditions are removed and their Green Cards become permanent.

Additionally, our investor also filed Form I-485 on the same date as their I-526E petition due to the benefit of concurrent filing.

Form I-485 is filed by EB-5 investors who already live in the United States on a non-immigrant visa—such as an H-1B. This petition adjusts an applicant’s immigration status to “pending.”

Once they have submitted Form I-485, EB-5 investors can apply for employment authorization documents (EADs) and advance parole (AP) travel documents so that they can work and travel while on their Green Cards. Many EB-5 investors have received EADs and APs in a matter of days.

Our investor received both their I-526E and I-485 approvals on July 25, 2024. Their Green Card was issued shortly after—only 9 months after their I-526E submission.

For U.S. Green Cards in Only Months, Invest in a Rural EB-5 Project

For the first time in its history, the EB-5 program is granting a unique benefit to investors in rural projects: priority processing. Regardless of their nationality, EB-5 investors in rural projects are seeing significantly faster I-526E and Green Card approvals—especially compared to investors in urban EB-5 projects.

The following I-526E processing data recently released by USCIS demonstrates the large difference between I-526E approval times for rural and urban projects.

EB5AN’s own rural and urban projects have certainly followed this trend. We have seen a 10.1-month difference between rural and urban I-526E approvals for our investors. While EB-5 investors in our rural projects are receiving I-526E approvals in an average of 10.4 months, the average for our urban investors is 20.1 months.

Rural May Be the Best Option For Chinese and Indian Nationals

Chinese and Indian EB-5 investors have even more reasons to consider investing in a rural EB-5 project.

Both China and India currently have a backlog of EB-5 applications, and investors from these countries have historically had to wait for additional months or even years before receiving their Green Cards.

Now, due to the introduction of the EB-5 Reform and Integrity Act of 2022, the EB-5 program offers special categories of set-aside visas for both rural and urban EB-5 projects. Chinese and Indian investors who get a set-aside visa can avoid these additional delays to get their Green Cards.

The set-aside visa category for rural EB-5 projects gets 20% of the total yearly supply of EB-5 visas. In contrast, urban EB-5 projects only get 10%, and the supply of urban set-aside visas is likely to enter a backlog soon.

Therefore, investing in a rural EB-5 project is the safest way for Chinese and Indian investors to avoid additional delays before receiving their Green Cards.

The United States is the most sought-after destination for immigrants, many of whom seek to advance their careers and studies or secure more opportunities for their children. Still, most of the available immigration options are unpractical, slow, or impose cumbersome limitations on employment.

For example, H-1B workers can only work in a certain industry and only for employers who sponsor them. If an H-1B worker is laid off, they and their family may have to leave the United States in only 60 days.

With the EB-5 program not requiring employer sponsor—and therefore not having such a risk—it’s no surprise that hundreds of H-1B workers have turned to the EB-5 program as the fastest path to a U.S. Green Card.

Holding a U.S. Green Card can allow you to start your own business, work in any industry, and work part or full time—or not work at all. You can also work while pursuing your studies. In addition, you may live anywhere in the United States, expanding both your social and economic opportunities.

Moreover, U.S. colleges and universities typically offer more accessible tuition rates for students who hold U.S. Green Cards than for those who arrive on student visas.
