Hard Rock Pointe Vista is a master-planned, all-seasons resort community under active development on Lake Texoma, along the Oklahoma-Texas border. Located about 100 miles from Dallas and within driving distance of both Dallas and Oklahoma City, the community offers year-round access to one of the most visited lakes in the United States. Lake Texoma draws approximately 6 million visitors each year and is widely known as a top destination for striped bass fishing, boating, and outdoor recreation. Its proximity to the Dallas-Fort Worth metroplex, the fourth-largest metropolitan area in the country with roughly 8.4 million residents, gives the resort a large and reliable base of weekend and holiday visitors.

The EB-5 project is funding the first phase of the resort, which features a Hard Rock-branded hotel, for-sale Hard Rock-branded residences, and a man-made bay amenity. The project’s Form I-956F, Application for Approval of an Investment in a Commercial Enterprise, has been approved by United States Citizenship and Immigration Services (USCIS), confirming that its structure, rural area qualification, and job creation methodology meet current EB-5 program requirements.

Construction Progress

Work advanced across multiple areas of the Pointe Vista community heading into July.

At the Hard Rock hotel site, land clearing is complete and heavy earthwork equipment remains active as the team prepares to begin construction of the hotel itself. This positions the EB-5 phase to move from site preparation into vertical development.

At Bridge Pointe, a neighborhood of single-family attached residences, homes are in the final stages of construction. At Reflection Pointe, a single-family home neighborhood within the master plan, site development work is in progress.

Beyond the project sites, the Roosevelt Bridge, a key crossing over Lake Texoma, is undergoing a multi-million dollar renovation scheduled for completion at the same time with the Hard Rock hotel’s opening. The improved crossing will support access to the resort for visitors arriving from the Dallas-Fort Worth area.

The surrounding community is already an active destination. The on-site casino offers more than 220 electronic games and 6 table games, while the golf clubhouse features a well-stocked merchandise shop and a cafeteria where players can enjoy snacks after a round. Existing amenities in the area also include a marina and an established golf course, giving the resort a base of operating attractions well before the EB-5 phase is complete.

To date, the developer group has spent more than $37 million on the project.

A Rural EB-5 Investment Built on Solid Ground

The Hard Rock Pointe Vista EB-5 investment is structured as a senior secured loan, backed by a first-position mortgage on the residences property, a second-position mortgage on the hotel and bay property, and a 100% equity pledge in the project company and its subsidiaries. Each EB-5 investor participates through an individual loan tranche with a five-year term that begins when the investor’s funds are fully disbursed to the project.

As a project located in a rural targeted employment area (TEA), Hard Rock Pointe Vista qualifies investors for the reduced $800,000 investment minimum, priority Form I-526E petition processing, and eligibility under the 20% rural visa set-aside created by the EB-5 Reform and Integrity Act of 2022. The rural set-aside category currently remains available for investors born in every country, including China and India, where the unreserved EB-5 category faces multi-year backlogs. Investors already in the United States in valid status may also be eligible to file Form I-485 concurrently with Form I-526E, providing access to work and travel authorization while the petition is pending.

Qualified spending to date has already created over 466 EB-5 eligible jobs, enough to satisfy the job creation requirement for the project’s first 46 investors. Upon completion, the project is expected to create more than 5,778 qualifying jobs. With a maximum of 250 EB-5 investors requiring 2,500 jobs in total, the expected figure is more than twice the number of jobs required for all investors to obtain permanent Green Cards.

Investor protections include a construction completion guaranty, an I-526E approval refund guaranty, and a job creation guaranty, addressing the key risks investors face across the construction, petition, and job creation stages of the process.

An Experienced Developer and Independent Oversight

Development of Hard Rock Pointe Vista is led by Mark A. Fischer, a serial entrepreneur with a long record of building successful companies across industries. The developer has contributed the land and tens of millions of dollars in cash to the project, and developer equity makes up nearly one-fifth of the EB-5 project’s financing.

The project is sponsored by a regional center operated by EB5AN, which is 100% independent from the developer. Independent sponsorship helps prevent conflicts of interest between the developer and the parties overseeing the EB-5 investment. EB5AN also provides full access to the project’s financial statements, so prospective investors can verify the project’s claims before committing capital.
