Because <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/h-1b-specialty-occupations\" target=\"_blank\" rel=\"noopener\">the H-1B visa<\/a> carries dual intent, there should be no disadvantageous influence on either EB-5 or H-1B applications. When filing the H-1B extension form, the EB-5 investor will be obliged to include mention of their pending EB5 petition.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/f0NQYupXkjw?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Dual Intent<\/h3>\n<p>The H-1B visa is one of the few nonimmigrant visas that permit dual intent. This means the H-1B visa holder is permitted to temporarily reside in the United States while expressing immigration intent. As such, a pending EB-5 petition, which is indicative of permanent immigrant intent and the desire to <a href=\"https:\/\/eb5visainvestments.com\/2021\/09\/13\/obtaining-a-u-s-green-card-through-the-eb-5-program\/\" target=\"_blank\" rel=\"noopener\">acquire a U.S. Green Card<\/a>, would not negatively influence the H-1B visa holder\u2019s status or any attempt to extend their H-1B visa.<\/p>\n<h3>H-1B Visa Extension<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-213_image-2.jpg\" \/><\/p>\n<p>The standard H-1B visa is generally valid for up to three years, after which point the visa holder may file for an extension. To do so, the visa holder\u2019s sponsoring employer must <a href=\"https:\/\/www.uscis.gov\/i-129\" target=\"_blank\" rel=\"noopener\">file Form I-129<\/a> on their behalf for an additional maximum of three years. They must append filing fees and supporting documents to the application. Such documents will likely include the applicant\u2019s unexpired passport, a valid Form I-94, a letter explaining their job within the company, university diploma(s) and transcript(s), W-2s and paychecks, and <a href=\"https:\/\/www.uscis.gov\/forms\/filing-guidance\/form-i-797-types-and-functions\" target=\"_blank\" rel=\"noopener\">the I-797 petition<\/a> originally issued by United States Citizenship and Immigration Services (USCIS) approving H-1B status.<\/p>\n<p>The sponsoring employer must file for an extension before the expiration of their employee\u2019s current H-1B visa. If the H-1B visa holder has a spouse and\/or children who need extensions, they will need to <a href=\"https:\/\/www.uscis.gov\/i-539\" target=\"_blank\" rel=\"noopener\">file Form I-539<\/a> for them.
