With a conditional Green Card, the EB-5 investor is permitted to study anywhere within the United States. They will also be eligible for reduced-cost in-state tuition for public colleges and universities. Statistically, having a <a href=\"https:\/\/eb5visainvestments.com\/2021\/09\/13\/obtaining-a-u-s-green-card-through-the-eb-5-program\/\" target=\"_blank\" rel=\"noopener\">U.S. Green Card<\/a> increases the possibility of being accepted to a post secondary institution by 350%.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/QvSY1HzQBlM?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>To acquire conditional permanent resident status, the EB5 investor must file and gain approval of Form I-526E; if they are already residing in the United States with a nonimmigrant visa at the time, they are eligible to <a href=\"https:\/\/eb5visainvestments.com\/2022\/03\/14\/eb-5-concurrent-filing-will-let-investors-live-work-and-study-in-the-united-states-sooner-than-before-with-an-eb-5-investment\/\" target=\"_blank\" rel=\"noopener\">concurrently file Form I-485<\/a> to adjust status.<\/p>\n<h3>F-1 Visa<\/h3>\n<p>If the foreign national is <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/students-and-exchange-visitors\/students-and-employment\" target=\"_blank\" rel=\"noopener\">an international student<\/a> who previously entered the United States on an <a href=\"https:\/\/www.uscis.gov\/i-9-central\/complete-correct-form-i-9\/completing-section-1-employee-information-and-attestation\/foreign-academic-students\" target=\"_blank\" rel=\"noopener\">F-1 (Academic Student) visa<\/a> before deciding to begin the EB-5 process and <a href=\"https:\/\/eb5affiliatenetwork.com\/i-526-petition\/\" target=\"_blank\" rel=\"noopener\">file Form I-526E<\/a>, they must comply with the stipulations of their F-1 visa, attend school, and complete their chosen program in accordance with the regulations of their F-1 visa. However, having an F-1 visa will not qualify the international student for lower cost in-state tuition. Qualifying for lower cost in-state tuition is only possible as a U.S. Green Card holder.<\/p>\n<h3>Dual Intent<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-207_image-2.jpg\" \/><\/p>\n<p>If the EB-5 investor had previously entered the United States on an F-1 visa, they will not be able to renew their F-1 visa once they begin the EB-5 process. The EB-5 visa is an immigrant visa and a pending I-526E petition is indicative of the applicant having the intent to relocate to the United States permanently. Maintaining status for the F-1 visa requires proof of temporary, nonimmigrant intent. Furthermore, the F-1 visa does not carry dual intent.
