Because the H-1B visa comes with a travel card, an EB-5 investor with an approved I-526E petition may travel even before adjusting status and receiving a <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-conditional-permanent-resident-status\/\" target=\"_blank\" rel=\"noopener\">conditional Green Card<\/a>.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/6B3CXtivUVU?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>H-1B Visa<\/h3>\n<p>Having an approved I-526E petition and H-1B visa simultaneously is acceptable because the H-1B visa has dual intent, which permits the visa holder to express immigrant intent through their participation in the EB-5 process and continue to reside in the United States temporarily. Therefore, having an H-1B visa will not compromise the EB5 investor\u2019s application process in any way.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-205_image-2.jpg\" \/><\/p>\n<p>In order to travel on <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/h-1b-specialty-occupations\" target=\"_blank\" rel=\"noopener\">an H-1B visa<\/a>, the visa itself must still be valid and the EB-5 investor must meet the visa\u2019s underlying conditions. Specifically, the EB-5 investor must continue to work for the sponsoring employer specified in their visa. They must also maintain a valid passport and <a href=\"https:\/\/www.uscis.gov\/forms\/all-forms\/form-i-94-arrivaldeparture-record-information-for-completing-uscis-forms\" target=\"_blank\" rel=\"noopener\">I-94 form (Arrival\/Departure Record)<\/a> at all times. In terms of traveling abroad, the H-1B visa holder may make personal trips, such as to visit friends or relatives, or professional trips, which could include attending an overseas conference or conducting business with work colleagues.<\/p>\n<h3>Approved I-526E petition<\/h3>\n<p>If the EB-5 investor had previously entered the United States on an H-1B visa prior to beginning the EB-5 process and their priority date is current at the time of <a href=\"https:\/\/www.uscis.gov\/i-526e\" target=\"_blank\" rel=\"noopener\">filing Form I-526E<\/a>, they would be eligible <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/concurrent-filing-of-form-i-485\" target=\"_blank\" rel=\"noopener\">for concurrent filing<\/a> of the I-526E and I-485 petitions.
