USCIS also requires investors to provide documentation proving a lawful source of funds for any <a href=\"https:\/\/eb5affiliatenetwork.com\/making-sense-eb-5-admin-fees\/\" target=\"_blank\" rel=\"noopener\">administrative fees<\/a> as of the enactment of the EB-5 Reform and Integrity Act of 2022.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/Pi_j2lzVwCU?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nUSCIS explains the details of the source-of-funds requirement in its <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-6-part-g-chapter-2\" target=\"_blank\" rel=\"noopener\">Policy Manual<\/a>, specifically Volume 6 (Immigrants), Part G (Investors), Chapter 2 (Eligibility Requirements), Section A(4), which reads:<\/p>\n<p class=\"left-para\">The immigrant investor must demonstrate by a preponderance of the evidence that the capital invested, or actively in the process of being invested, in the new commercial enterprise was obtained through lawful means. [\u2026] In establishing that the capital was acquired through lawful means, the immigrant investor must provide evidence demonstrating the direct and indirect source of his or her investment capital.<\/p>\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/wex\/preponderance_of_the_evidence\" target=\"_blank\" rel=\"noopener\">Legal Information Institute<\/a> at Cornell Law School defines \u201cpreponderance of the evidence\u201d as \u201cthe burden of proof is met when the party with the burden convinces the fact finder that there is a greater than 50% chance that the claim is true.\u201d This means that an EB-5 investor must prove with 51% certainty that their funds were legally obtained to meet the evidentiary standard as set by USCIS.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-76_image-2.jpg\" \/><br \/>\nLawful sources of an EB-5 investor\u2019s capital for both their EB-5 investment and administrative fees can include real estate sales, gifts, salary payments, inheritance, loans, stock proceeds, and more. EB-5 investment funds can be derived from several sources. As such, EB-5 investors sometimes need to submit <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-visa-program-source-of-funds-requirements-a-detailed-summary\/\" target=\"_blank\" rel=\"noopener\">multiple forms of evidence<\/a> with their I-526E petition to document the sources of all their funds.<br \/>\nBecause of the complexity of source-of-fund requirements, EB-5 investors should work with EB-5 immigration counsel to ensure that their I-526E petition meets USCIS requirements.
