The <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/students-and-exchange-visitors\/exchange-visitors\" target=\"_blank\" rel=\"noopener\">exchange visitor program<\/a> requires participants to return to their home country for at least two years upon completion of the program. If a J-1 or J-2 visa holder cannot fulfill this requirement, they must apply and receive approval of a <a href=\"https:\/\/www.uscis.gov\/i-612\" target=\"_blank\" rel=\"noopener\">waiver, Form I-612<\/a>, before being able to apply for another visa, such as <a href=\"https:\/\/eb5visainvestments.com\/2022\/01\/17\/how-to-qualify-for-an-eb-5-visa\/\" target=\"_blank\" rel=\"noopener\">the EB-5 visa<\/a>. Without receiving approval for a waiver, a J-1 or J-2 visa holder will not be eligible to adjust status to conditional permanent resident by becoming an EB-5 investor.<br \/>\nHowever, for J-1 and J-2 visa holders who successfully acquire a waiver or fulfill the two-year home-country physical presence requirement, becoming an EB-5 investor is certainly possible. The first step is to hire an experienced immigrant attorney to help navigate the complexities of the EB-5 process, <a href=\"https:\/\/eb5affiliatenetwork.com\/importance-due-diligence-eb-5-investors\/\" target=\"_blank\" rel=\"noopener\">conduct due diligence<\/a> to identify suitable projects, and select a project with minimal <a href=\"https:\/\/eb5visainvestments.com\/2021\/12\/10\/risks-factors-for-eb-5-investors\/\" target=\"_blank\" rel=\"noopener\">financial and immigration risk<\/a>.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/xqTRyrvGWow?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nAfter selecting a promising project to invest in, the EB5 investor and their attorney can begin gathering the necessary documentation to file <a href=\"https:\/\/www.uscis.gov\/i-526e\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a>. This petition will be adjudicated by United States Citizenship and Immigration Services (USCIS) based on a number of elements, including compliance with EB-5 regulations and proof that the <a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/26\/what-is-the-minimum-eb-5-investment-amount\/\" target=\"_blank\" rel=\"noopener\">minimum investment amount<\/a> will be used to generate employment within an eligible new commercial enterprise (NCE).<br \/>\nA successful <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">I-526E petition<\/a> will result in a two-year conditional residency period. Upon completion of this period, the EB-5 investor can file Form I-829 for permanent resident status.
