Known as derivative beneficiaries, the spouse and any <a href=\"https:\/\/eb5visainvestments.com\/2022\/09\/02\/the-benefits-of-the-eb-5-visa-program-for-investors-with-children\/\" target=\"_blank\" rel=\"noopener\">unmarried children under the age of 21<\/a> receive their U.S. Green Card along with the primary applicant\u2014in this case, the EB-5 investor. This happens when <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a>\u2014Immigrant Petition by Regional Center Investor\u2014is adjudicated by United States Citizenship and Immigration Services (USCIS). Should an investor\u2019s child reach the age of 21 before Form I-526E is approved, they are still eligible to receive U.S. permanent resident status under the protection of the Child Status Protection Act, so long as Form I-526E was submitted prior to the dependent turning 21.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/4pn7ZTeou-s?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Child Status Protection Act<\/h3>\n<p>Prior to the passing of the <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/child-status-protection-act-cspa\" target=\"_blank\" rel=\"noopener\">Child Status Protection Act<\/a>, a major concern for EB-5 investors with minor children was that their children would \u201cage out\u201d of the EB-5 visa process by reaching the age of 21 before Form I-526E was adjudicated. Because so many children were \u201caging out,\u201d the act was passed to allow a child\u2019s age to \u201cfreeze\u201d the date that Form I-526E is submitted, not adjudicated. This was also due to USCIS having long backlogs for countries with high demand for EB-5 visas.<\/p>\n<h3>Adjustment of Status<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-271_image-2.jpg\" \/><br \/>\nOnce an EB-5 investor and their derivative beneficiaries receive conditional <a href=\"https:\/\/eb5visainvestments.com\/2022\/08\/17\/eb-5-permanent-resident-status-what-eb-5-investors-need-to-know\/\" target=\"_blank\" rel=\"noopener\">permanent resident status<\/a>, they must adjust their status. If they are residing in their home country, they must consular process within a year of I-526E approval. However, if they are residing in the United States, they can file <a href=\"https:\/\/eb5affiliatenetwork.com\/485-application-change-status\/\" target=\"_blank\" rel=\"noopener\">Form I-485<\/a>\u2014Application to Register Permanent Residence or Adjust Status. EB-5 visa applicants who reside in the United States can also file Forms I-526E and I-485 concurrently thanks to the <a href=\"https:\/\/eb5affiliatenetwork.com\/changes-to-the-eb-5-industry-under-the-eb-5-reform-and-integrity-act\/\" target=\"_blank\" rel=\"noopener\">EB-5 Reform and Integrity Act of 2022<\/a>.
