However, this can only be done after <a href=\"https:\/\/eb5affiliatenetwork.com\/a-guide-to-form-i-829\/\" target=\"_blank\" rel=\"noopener\">Form I-829<\/a>\u2014Petition by Investor to Remove Conditions on Permanent Resident Status\u2014has been submitted and approved. If an EB5 investor abandons their Green Card prior to I-829 approval, any and all dependents will lose their status as well.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/k2hj_RGJ-zY?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Derivative Beneficiaries<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-268_image-2.jpg\" \/><br \/>\nThe EB-5 visa process allows an EB-5 investor to include their immediate family members in their petition for a U.S. Green Card. These family members\u2014a spouse and any <a href=\"https:\/\/eb5visainvestments.com\/2022\/09\/02\/the-benefits-of-the-eb-5-visa-program-for-investors-with-children\/\" target=\"_blank\" rel=\"noopener\">unmarried children under the age of 21<\/a>\u2014are known as derivative beneficiaries. They are only eligible to apply for a visa based on their relation to the principal applicant who, in this case, is the EB-5 investor. They must fulfill all the same requirements as the applicant, including submitting required documentation and participating in a <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-visa-interview\/\" target=\"_blank\" rel=\"noopener\">visa interview<\/a> if they are residing outside of the United States. They also receive all of the same benefits of U.S. permanent residency as the principal applicant.<\/p>\n<h3>Conditional Permanent Residency<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-268_image-3.jpg\" \/><br \/>\nOnce an EB-5 investor\u2019s <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a>\u2014Immigrant Petition by Regional Center Investor\u2014has been adjudicated, they and their immediate family members are granted U.S. permanent residency. However, this permanent residency is conditional and only granted for a period of two years. During that time, United States Citizenship and Immigration Services (USCIS) will continue to monitor the EB-5 investment project. As long as the investment project continues to meet all of the agency\u2019s requirements\u2014including the creation and maintenance of at least <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-job-creation\/\" target=\"_blank\" rel=\"noopener\">10 U.S. jobs<\/a>\u2014the investor may submit Form I-829. It is in the investor\u2019s best interest to work with an <a href=\"https:\/\/eb5affiliatenetwork.com\/how-to-choose-an-eb-5-immigration-attorney\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> to ensure that Form I-829 is submitted at the appropriate time.
