As is customary, one individual will assume the role of the primary EB-5 investor and they will be able to claim their spouse as a derivative beneficiary.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/FiAlgr1Szyc?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Same-Sex Marriages<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-266_image-2-1.jpg\" \/><br \/>\nIn 2013, the U.S. Supreme Court declared Section 3 of the Defense of Marriage Act (DOMA) unconstitutional, making it so that the federal government must recognize <a href=\"https:\/\/www.uscis.gov\/family\/same-sex-marriages\" target=\"_blank\" rel=\"noopener\">same-sex marriages<\/a> conducted by the states.<br \/>\nTo that end, on July 1, 2013, the Secretary of Homeland Security released a statement announcing that in the wake of the new legislation, \u201cUnited States Citizenship and Immigration Services (USCIS) [will] review immigration visa petitions filed on behalf of a same-sex spouse in the same manner as those filed on behalf of an opposite-sex spouse.\u201d<br \/>\nOn the website of USCIS, it further specifies that \u201cas a general matter, the law of the place where the marriage was celebrated determines whether the marriage is legally valid for immigration purposes. Just as USCIS applies all relevant laws to determine the validity of an opposite-sex marriage, we will apply all relevant laws to determine the validity of a same-sex marriage.\u201d<\/p>\n<h3>Applying for an EB-5 Visa and the New I-526E Petitions<\/h3>\n<p>As mentioned, one member of the married same-sex couple should assume the role of the primary EB-5 investor. To begin the EB-5 process, the investor must file Form I-526E.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-266_image-3.jpg\" \/><br \/>\nTo accommodate the <a href=\"https:\/\/eb5affiliatenetwork.com\/changes-to-the-eb-5-industry-under-the-eb-5-reform-and-integrity-act\/\" target=\"_blank\" rel=\"noopener\">EB-5 Reform and Integrity Act of 2022<\/a>, USCIS revised Form I-526 and <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/uscis-releases-new-forms-for-immigrant-investor-program-0\" target=\"_blank\" rel=\"noopener\">split it into two versions<\/a>: Form I-526, <a href=\"https:\/\/www.uscis.gov\/i-526\" target=\"_blank\" rel=\"noopener\">Immigrant Petition by Standalone Investor<\/a>, and Form I-526E, <a href=\"https:\/\/www.uscis.gov\/i-526e\" target=\"_blank\" rel=\"noopener\">Immigrant Petition by Regional Center Investor<\/a>. The former resembles the original I-526 petition and is designated for standalone investors who are not looking to pool their capital with other EB-5 investors, while the latter is designed for EB-5 investors looking to merge their investment funds with that of other investors under <a href=\"https:\/\/eb5affiliatenetwork.com\/what-is-an-eb-5-regional-center\/\" target=\"_blank\" rel=\"noopener\">the regional center program<\/a>.
