In accordance with the regulations of the EB-5 program, for the dependent child of an EB-5 investor to be claimed as a derivative, the child must be unmarried and under the age of 21 at the time <a href=\"https:\/\/eb5visainvestments.com\/2023\/09\/22\/eb5an-partners-with-anahita-george-to-bring-transparency-to-eb-5-source-of-funds\" target=\"_blank\" rel=\"noopener\">Form I-526E is filed<\/a>. By marrying before a Green Card is issued, the dependent child would disqualify themselves from accompanying the primary EB-5 investor\u2019s immigration petition.<br \/>\nOnce the EB-5 investor has successfully completed adjustment of status or consular processing and been issued <a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/26\/the-eb5-green-card-process\/\" target=\"_blank\" rel=\"noopener\">a U.S. Green Card<\/a>, the dependent child will be free to marry. However, the child\u2019s spouse will not be considered a derivative beneficiary of the principal EB-5 investor. If the child\u2019s spouse wishes to pursue immigration, they would likely need to file for a family-based Green Card, such as an F2A spousal petition.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/QKpGyXYqaSE?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Eligible Dependents of the EB-5 Program<\/h3>\n<p>For immigration purposes, <a href=\"https:\/\/www.uscis.gov\/family\/bring-children-to-live-in-the-US\" target=\"_blank\" rel=\"noopener\">the definition of a \u201cchild\u201d<\/a> is an individual who is unmarried and under the age of 21. This definition is applicable to the EB-5 program in determining the eligibility of derivative children. Thus, the earliest point during the EB-5 process at which a derivative child could marry would be after they become a lawful permanent resident.<\/p>\n<h3>F2A Category<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-274_image-2.jpg\" \/><br \/>\nWhile the dependent child\u2019s spouse will not be eligible to become a derivative beneficiary, they may pursue a Green Card based on a <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-for-family-preference-immigrants\" target=\"_blank\" rel=\"noopener\">family preference category<\/a>\u2014specifically, the second preference (F2A), which includes the spouses and children (unmarried and under 21 years of age) of lawful permanent residents.<br \/>\nAs a lawful permanent resident, the dependent child is entitled to petition for their spouse\u2019s immigration by filing <a href=\"https:\/\/www.uscis.gov\/i-130\" target=\"_blank\" rel=\"noopener\">Form I-130, Petition for Alien Relative<\/a>. The dependent child must prove their own lawful permanent residence by appending a copy of their <a href=\"https:\/\/www.uscis.gov\/i-9-central\/temporary-i-551-stamps-and-mrivs\" target=\"_blank\" rel=\"noopener\">Permanent Resident Card (Form I-551)<\/a>.
