Form I-526 petitions would often take years to be approved, causing delays in investors\u2019 immigration plans. All EB-5 visas also came from a single pool, which would lead to longer wait times for investors from <a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/15\/eb-5-visa-retrogression-deepens-for-indian-nationals\/\" target=\"_blank\" rel=\"noopener\">high-demand countries<\/a>.<\/p>\n<h4 id=\"h3\">Post-RIA Improvements<\/h4>\n<p>Now, with the RIA, we are seeing <a href=\"https:\/\/eb5visainvestments.com\/2024\/05\/22\/what-you-need-to-know-about-the-new-eb-5-processing-times\/\" target=\"_blank\" rel=\"noopener\">faster processing times<\/a>. New policies have also helped reduce backlogs, which has made the overall process faster for new investors. <\/p>\n<p>A big factor in wait times being cut was the <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-rural-tea-projects\/#:~:text=Each%20year%2C%20USCIS%20now%20sets%20aside%2032%25%20of,types%20of%20projects%20qualify%20for%20reserved%20EB-5%20visas.\" target=\"_blank\" rel=\"noopener\">introduction of reserved visas<\/a> for specific targeted employment areas (TEAs). Under the RIA, 20% of EB-5 visas are now reserved for rural TEA investments, 10% for high-unemployment TEAs, and 2% for infrastructure projects. These <a href=\"https:\/\/eb5affiliatenetwork.com\/exploring-the-differences-between-eb-5-rural-high-unemployment-and-infrastructure-project-investments\/\" target=\"_blank\" rel=\"noopener\">reserved visa categories<\/a> also give investors more choices when selecting investment projects that work best for them.<\/p>\n<p>For example, rural TEA projects are being processed more quickly, with some I-526E petitions <a href=\"https:\/\/eb5visainvestments.com\/2024\/04\/01\/multiple-i-526e-approvals-in-12-months-for-eb-5-investors-in-twin-lakes-georgia-fastest-approval-in-only-9-5-months\/\" target=\"_blank\" rel=\"noopener\">being approved in as little as 12 months<\/a>. This is because of <a href=\"https:\/\/eb5visainvestments.com\/2024\/06\/21\/rural-eb-5-investment-a-faster-path-to-u-s-green-cards\/\" target=\"_blank\" rel=\"noopener\">priority processing for rural investments<\/a>, which makes them a good option for investors wanting quicker outcomes.<\/p>\n<p>However, while the post-RIA changes have generally led to faster processing times, approval times can still vary depending on individual circumstances. Circumstances include the type of investment, the investor\u2019s home country, and the current demand for EB-5 visas.<\/p>\n<h3 id=\"h4\">Concurrent Filing<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2024\/08\/image2-17.jpg\" alt=\"A national visa center officer's hands searching through a stack of files and documents.\"><\/p>\n<h4 id=\"h5\">Pre-RIA Process<\/h4>\n<p>Prior to the RIA, all EB-5 investors had to wait for I-526 petition approval before they could apply for adjustment of status or consular processing.<\/p>\n<h4 id=\"h6\">Post-RIA Advantages<\/h4>\n<p>The RIA introduced <a href=\"https:\/\/eb5visainvestments.com\/2022\/03\/14\/eb-5-concurrent-filing-will-let-investors-live-work-and-study-in-the-united-states-sooner-than-before-with-an-eb-5-investment\/\" target=\"_blank\" rel=\"noopener\">concurrent filing<\/a>, which has multiple benefits:<\/p>\n<li>Eligible investors who are based in the U.S. can now file Form I-526E and Form I-485 (adjustment of status) at the same time.<\/li>\n<li>Investors can get work permits and travel authorization sooner, with many getting <a href=\"https:\/\/eb5visainvestments.com\/2024\/03\/11\/multiple-investors-in-eb5ans-twin-lakes-project-receive-work-and-travel-authorization-as-quickly-as-30-days\/\" target=\"_blank\" rel=\"noopener\">approved in as little as 90 days<\/a>.<\/li>\n<li>Investors can live and work in the U.S. like Green Card holders even before I-526E petition approval.<\/li>\n<h3 id=\"h7\">Investment Options<\/h3>\n<h4 id=\"h8\">Pre-RIA Structure<\/h4>\n<p>The pre-RIA structure had two types of investments, <a href=\"https:\/\/eb5affiliatenetwork.com\/difference-between-eb-5-direct-investments-and-regional-center-projects\/\" target=\"_blank\" rel=\"noopener\">regional center and direct<\/a>, with targeted employment areas offering a lower investment amount. <\/p>\n<h4 id=\"h9\">Post-RIA Changes<\/h4>\n<p>The RIA introduced more investment options to choose from, each with its own benefits. New EB-5 investors can now invest in rural TEAs, high-unemployment or urban TEAs, or specific infrastructure projects. <\/p>\n<p>Non-TEA investments are still available, but they require a higher investment than TEAs and <a href=\"https:\/\/eb5visainvestments.com\/2024\/08\/01\/how-to-read-the-visa-bulletin-a-complete-guide-for-eb-5-investors\/\" target=\"_blank\" rel=\"noopener\">currently face backlogs<\/a>.<\/p>\n<p>Before the RIA, the minimum investment for TEA projects was $500,000, while non-TEA investments required $1 million. Under the new rules, these amounts have increased to $800,000 for TEA projects and $1.05 million for non-TEA projects.<\/p>\n<h3 id=\"h10\">Requirements and Regulation Changes<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2024\/08\/image5-12.jpg\" alt=\"A hand holding a passport above some visa application documents and forms.\"><\/p>\n<h4 id=\"h11\">Pre-RIA Standards<\/h4>\n<p>Previously, regional centers and projects were under less scrutiny, allowing for lack of transparency or incidents of fraud. <\/p>\n<p>The EB-5 capital had to remain invested and at risk throughout the investor\u2019s two-year conditional residency, which often created <a href=\"https:\/\/eb5visainvestments.com\/2024\/04\/23\/its-time-for-an-honest-conversation-about-the-redeployment-of-eb-5-investor-funds\/\" target=\"_blank\" rel=\"noopener\">the need for redeployment<\/a> due to processing delays. <\/p>\n<h4 id=\"h12\">Post-RIA Changes<\/h4>\n<p>Regional centers now have to file new forms like <a href=\"https:\/\/eb5visainvestments.com\/2022\/06\/03\/uscis-releases-new-form-i-956f-for-eb-5-project-requests\/\" target=\"_blank\" rel=\"noopener\">Form I-956<\/a> and <a href=\"https:\/\/eb5visainvestments.com\/2024\/05\/04\/eb5an-leads-the-eb-5-industry-with-form-i-956f-approvals-and-no-rfes\/\" target=\"_blank\" rel=\"noopener\">Form I-956F<\/a> to meet new regulations. There are also <a href=\"https:\/\/eb5visainvestments.com\/2024\/04\/22\/how-does-uscis-audit-eb-5-regional-centers\/\" target=\"_blank\" rel=\"noopener\">more thorough checks on regional centers<\/a> and project developers to add more integrity and transparency to the EB-5 program. <\/p>\n<p>Another change that the RIA brought was removing the requirement to keep the EB-5 capital invested throughout the entire conditional residency period. <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/uscis-provides-additional-guidance-for-eb-5-required-investment-timeframe-and-investors-associated\" target=\"_blank\" rel=\"noopener\">USCIS\u2019s interpretation<\/a> of the legislation redefined the <a href=\"https:\/\/www.forbes.com\/councils\/forbesbusinesscouncil\/2024\/07\/03\/eb-5-program-reform-understanding-the-impact-of-the-ria-amendment\/\" target=\"_blank\" rel=\"noopener\">EB-5 investment sustainment period<\/a> to be \u201cat least two years\u201d starting on the day the new commercial enterprise (NCE) receives the investment. <\/p>\n<h3 id=\"h13\">Learn More About the EB-5 Reform and Integrity Act<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2024\/08\/image4-17.jpg\" alt=\"An EB5 regional center team working with alien entrepreneurs at an office desk next to the EB5AN logo.\"><\/p>\n<p>The EB-5 Reform and Integrity Act has brought significant changes to the program for foreign nationals seeking a U.S. Green Card.
