Similarly, to qualify for <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noopener\">an L-1B visa<\/a>, the employee must be pursuing entry to the United States in order to provide services related to their field of specialized knowledge to a subsidiary branch of their employer based in the United States.<\/p>\n<p>For both the L-1A and L-1B visas, the employer must <a href=\"https:\/\/www.uscis.gov\/i-129\" target=\"_blank\" rel=\"noopener\">file Form I-129<\/a> on behalf of the prospective visa holder to acquire lawful authorization for the employee to work and live in the United States.<\/p>\n<h3>Form I-526E, Immigrant Petition by Alien Entrepreneur<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-214_image-3.jpg\" \/><\/p>\n<p>If the EB-5 investor\u2019s I-526E petition is approved while they are still overseas, they will have to <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/consular-processing\" target=\"_blank\" rel=\"noopener\">undergo consular processing<\/a>.
