Therefore, even if the <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">I-526E petition<\/a> is approved, the <a href=\"https:\/\/eb5affiliatenetwork.com\/485-application-change-status\/\" target=\"_blank\" rel=\"noopener\">I-485 application<\/a> for adjustment of status will likely fail. Additionally, any money earned while out of status cannot be used to fund the EB-5 investment, as United States Citizenship and Immigration Services (USCIS) will not consider the funds \u201clawfully obtained.\u201d However, the person may be able to apply for the EB-5 program if they leave the United States and allow the prescribed time to elapse before applying, or if the Department of Homeland Security (DHS) grants a waiver of ineligibility.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/nURlaOqoDVU?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>How an <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/visa-denials.html\" target=\"_blank\" rel=\"noopener\">overstay affects a visa application<\/a> is set out in section 212(a)(9)(B)(i) of the Immigration and Nationality Act (INA). The main factors affecting visa eligibility after an overstay are how long the person remained in the United States illegally, how long ago it happened, and why the person remained in the country while out of status. If the person remained in the country for more than 180 days but less than a year, they will be ineligible for a U.S. visa for three years. If they remained for more than a year, the ineligibility period increases to 10 years.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-201_image-2.jpg\" \/><\/p>\n<p>DHS might waive ineligibility, at its discretion, under certain circumstances. For example, it may waive ineligibility if denying an applicant <a href=\"https:\/\/eb5affiliatenetwork.com\/us-immigrant-visas\/\" target=\"_blank\" rel=\"noopener\">a U.S. visa<\/a> will cause extreme hardship for a member of the applicant\u2019s immediate family who is a lawful permanent resident or a U.S. citizen. <a href=\"https:\/\/www.uscis.gov\/i-601\" target=\"_blank\" rel=\"noopener\">Form I-601<\/a> is used to apply for a waiver.<\/p>\n<p>This aspect of immigration law is extremely complex, so it would be best to work with an immigration attorney to find a <a href=\"https:\/\/eb5affiliatenetwork.com\/eb5-visa\/steps-obtain-eb-5-green-card\/\" target=\"_blank\" rel=\"noopener\">path to a U.S. visa<\/a>.
