It also depends on the limitations set by<a href=\"https:\/\/eb5visainvestments.com\/2020\/04\/22\/what-the-eb-5-at-risk-requirement-means\/\" target=\"_blank\" rel=\"noopener\"> the \u201cat risk\u201d requirement<\/a> of the EB-5 program.<br \/>\nMany regional centers offer a return of the investment if an investor\u2019s I-526E petition is denied, known as an I-526E refund guaranty. On some projects, EB5AN <a href=\"https:\/\/eb5visainvestments.com\/2019\/10\/04\/new-initiative-announced-by-eb5-affiliate-network-to-safeguard-eb-5-investors-funds\/\" target=\"_blank\" rel=\"noopener\">extends this refund guaranty<\/a> to include the refunding of attorney\u2019s fees and USCIS filing fees, which can be considerable, if the I-526E petition is denied.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/4i0mDW1krhY?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nIn terms of the at-risk <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-6-part-g-chapter-2\" target=\"_blank\" rel=\"noopener\">requirement of the EB-5 program<\/a>, for funds to remain at risk, there must be a risk of loss and a chance for gain. While it is considered permissible for an EB-5 investor\u2019s investment funds to be <a href=\"https:\/\/eb5affiliatenetwork.com\/trends-eb-5-escrow-agreements\/\" target=\"_blank\" rel=\"noopener\">held in escrow<\/a> until their I-526E petition is approved, an agreement between an investor and a new commercial enterprise (NCE) that guarantees the repayment of EB5 investment funds after I-526E approval and the granting of conditional permanent resident status is considered impermissible. If repayment is guaranteed, there is no risk of loss, which means the investment does not satisfy the at-risk requirement.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2022\/12\/FAQ-13_image-2.jpg\" \/><br \/>\nBecause repayment cannot be guaranteed at later stages of the EB-5 process, investors should not expect repayment of their EB-5 investment funds on denial of <a href=\"https:\/\/eb5affiliatenetwork.com\/a-guide-to-form-i-829\/\" target=\"_blank\" rel=\"noopener\">the I-829 petition<\/a>. However, if the NCE made a loan to the job-creating enterprise (JCE) and the loan comes due, the investor may be able to recover their investment if the JCE has the funds available to repay the loan to the NCE.<br \/>\nFinally, regional centers are unlikely to return capital if the investor\u2019s EB-5 visa is denied due to inadmissibility.
