{"id":65605,"date":"2023-02-16T06:30:29","date_gmt":"2023-02-16T06:30:29","guid":{"rendered":"https:\/\/eb5visainvestments.com\/wordpress\/?p=65605"},"modified":"2024-02-05T07:18:43","modified_gmt":"2024-02-05T07:18:43","slug":"march-2023-visa-bulletin-additional-delays-for-india-progress-in-chinese-eb-5-backlog","status":"publish","type":"post","link":"https:\/\/eb5visainvestments.com\/tr\/march-2023-visa-bulletin-additional-delays-for-india-progress-in-chinese-eb-5-backlog\/","title":{"rendered":"EB5 Latest News Visa Bulletin March 2023: Additional Delays for India, Progress in Chinese EB-5 Backlog"},"content":{"rendered":"<p>In keeping with its recent trend of slower processing for EB-5 petitions, United States Citizenship and Immigration Services (USCIS) has moved back the cut off date for Indian investors by 17 months in the <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/visa-law0\/visa-bulletin\/2023\/visa-bulletin-for-march-2023.html\" target=\"_blank\" rel=\"noopener\">March 2023 Visa Bulletin<\/a><\/p>\n<p>This significant increase in the backlog of pending EB-5 petitions will be detrimental to Indian EB-5 investors who filed their EB-5 petitions before March 2022.<\/p>\n<p>They may now face additional months or years of delays before obtaining their EB-5 Green Cards.<\/p>\n<p><a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/06\/eb-5-petition-processing-data-for-fy2022-q4-significant-backlogs-and-low-receipt-volumes\/\" target=\"_blank\" rel=\"noopener\">Recent processing data<\/a> for USCIS EB-5 applications shows that the agency\u2019s processing capacity is becoming increasingly limited.<\/p>\n<p>At the same time, Chinese investors received good news in the Visa Bulletin 2023: their cutoff date moved forward by almost four months.<\/p>\n<p>This will allow more Chinese investors with pending applications to obtain their Green Cards and immigrate to the United States.<\/p>\n<p>In this overview of the March 2023 Visa Bulletin, we explain how the new cutoff dates will affect Chinese and Indian investors who filed their immigrant petitions before March 2022.<\/p>\n<p>We then explain how new investors from both China and India can avoid these delays by investing in a rural <a href=\"https:\/\/eb5visainvestments.com\/2022\/09\/06\/why-you-should-invest-in-an-eb-5-targeted-employment-area-project\/\" target=\"_blank\" rel=\"noopener\">targeted employment area<\/a> (TEA) project through an EB-5 regional center.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/3-China-and-India-1.jpg\" \/><\/p>\n<div class=\"form-guide\">\n<h6 id=\"heading1\"><a href=\"#h1\">Analyzing the Visa Bulletin March 2023<\/a><\/h6>\n<ul class=\"form-guide-list\">\n<li id=\"heading3\"><a href=\"#h2\">The Role of Cut Off and Priority Dates<\/a><\/li>\n<li id=\"heading4\"><a href=\"#h3\">Cut Off Dates in the Visa Bulletin March 2023<\/a><\/li>\n<\/ul>\n<h6 id=\"heading5\"><a href=\"#h4\">Checking Your Priority Date on the Visa Bulletin<\/a><\/h6>\n<h6 id=\"heading6\"><a href=\"#h5\">Avoiding EB-5 Visa Delays by Investing in a Rural TEA Project<\/a><\/h6>\n<ul class=\"form-guide-list\">\n<li id=\"heading7\"><a href=\"#h6\">Low-Risk TEA Projects<\/a><\/li>\n<\/ul>\n<\/div>\n<h3 id=\"h1\">Analyzing the March 2023 Visa Bulletin March 2023<\/h3>\n<h4 id=\"h2\">The Role of Cut Off and Priority Dates<\/h4>\n<p>Each country is entitled to only a limited number of EB-5 visas each year.<\/p>\n<p>While this is not a problem for most countries, which do not have a particularly high volume of EB-5 applicants, nationalities with high demand for EB-5 immigration may find that <a href=\"https:\/\/eb5affiliatenetwork.com\/understanding-the-eb-5-visa-option-and-visa-retrogression-for-indian-nationals\/\" target=\"_blank\" rel=\"noopener\">their demand exceeds supply<\/a>.<\/p>\n<p>When the number of EB-5 investors from a certain country exceeds the number of available visas, a backlog forms.<\/p>\n<p>The USCIS then assigns cut off dates to investors of this nationality to determine when they can receive their EB-5 Green Cards and immigrate to the United States.<\/p>\n<p>An EB-5 investor can only move forward in the immigration process if they submitted <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a> (the initial EB-5 immigrant petition) before the applicable cut off date.<\/p>\n<p>Since USCIS often moves cut off dates forward slowly and unpredictably, many investors have experienced months &#8211; or years-long processing delays due to limited visa supply.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/2-Form-I-526E.jpg\" \/><\/p>\n<p>As of the March 2023 Visa Bulletin, both China and India are experiencing a backlog of EB-5 immigrant petitions. Investors from these countries are subject to cut off dates.<\/p>\n<p>These delays are certainly detrimental to investors who would like to immigrate to the United States with their families as soon as possible.<\/p>\n<p>Career and academic goals may have to be postponed due to additional processing times.<\/p>\n<h4 id=\"h3\">Cut Off Dates in the Visa Bulletin March 2023<\/h4>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/image1-2.png\" \/><\/p>\n<p><i>Chart A<\/i><\/p>\n<p>Reflected above is the final action dates chart, which determines when EB-5 investors can receive their EB-5 Green Cards.<\/p>\n<p>The most notable change in this month\u2019s Visa Bulletin is that India\u2019s final action date has moved back from November 8, 2019, to June 1, 2018 in a 17-month reversal.<\/p>\n<p>Indian EB-5 applicants who filed their I-526E petitions on or after June 1, 2018 are not yet eligible for Green Cards.<\/p>\n<p>It is unclear whether USCIS will continue to move back the final action date for India even further in the coming months.<\/p>\n<p>In contrast, China\u2019s final action date moved forward from March 22, 2015 to July 8, 2015\u2014nearly four months.<\/p>\n<p>As China has historically produced the highest volume of demand for EB-5 immigration, this is a welcome development for applicants with pending EB-5 petitions.<\/p>\n<p>China\u2019s final action date had not advanced in several months, and the country has been experiencing a visa backlog since 2015.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/image2-5.png\" \/><\/p>\n<p><i>Chart B<\/i><\/p>\n<p>The dates for filing, announced in Chart B of each Visa Bulletin, determine when investors can apply for their EB-5 visas after receiving approval for Form I-526E.<\/p>\n<p>The dates for filing for both China and India have not been adjusted this month: they remain at January 1, 2016, and December 8, 2019, respectively.<\/p>\n<p>While pre-March 2022 investors from both China and India cannot avoid these delays, new investors of these nationalities can easily avoid cutoff dates by <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-rural-tea-projects\/\" target=\"_blank\" rel=\"noopener\">investing in a rural TEA project<\/a>.<\/p>\n<h3 id=\"h4\">Checking Your Priority Date on the Visa Bulletin<\/h3>\n<p>Any questions regarding your cut off date for a specific month can be confirmed by looking at the Visa Bulletin.<\/p>\n<p>You can find your priority date on the <a href=\"https:\/\/www.uscis.gov\/forms\/filing-guidance\/form-i-797-types-and-functions\" target=\"_blank\" rel=\"noopener\">I-797 Notice Of Action<\/a> that will be mailed by the USCIS after they receive <a href=\"https:\/\/www.uscis.gov\/i-130\" target=\"_blank\" rel=\"noopener\">Form I-130<\/a> for processing.<\/p>\n<p>Alternatively, you can use the approval notice that the USCIS sends after approving the petition.<\/p>\n<p>The applicant\u2019s priority date is in the top section of the document.<\/p>\n<h3 id=\"h5\">Avoiding EB-5 Visa Delays by Investing in a Rural TEA Project<\/h3>\n<p>The EB-5 Reform and Integrity Act of 2022 (the RIA), signed into law in March 2022, introduced <a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/06\/how-set-aside-visas-can-accelerate-the-eb-5-immigration-process\/\" target=\"_blank\" rel=\"noopener\">three categories of reserved, or set-aside, visas:<\/a><\/p>\n<ul>\n<li>Rural TEA projects.<\/li>\n<li>High-unemployment TEA projects.<\/li>\n<li>Infrastructure projects.<\/li>\n<\/ul>\n<p>Foreign nationals who invest in one of these project categories (before the set-aside visa supply is exhausted) will qualify for a reserved visa and thus be able to avoid cut off dates\u2014even if their country has a backlog of EB-5 applications.<\/p>\n<p>While high-unemployment TEA and infrastructure projects receive only 10% and 2% of the total EB-5 visa supply, respectively, rural TEA projects get 20%.<\/p>\n<p>Since the supply of set-aside rural TEA visas is far more ample than the other two categories, rural TEA projects are the safest options for Chinese and Indian investors looking to avoid delays.<\/p>\n<p>At the same time, EB-5 investors should carefully evaluate rural TEA investment opportunities to determine whether they can succeed financially, create the required jobs, and ultimately result in Green Cards and a return on their capital.<\/p>\n<h3 id=\"h6\">Low-Risk TEA Projects<\/h3>\n<p>EB5AN is offering investors two industry-leading rural TEA projects: <a
