After receiving approval of Form I-526E, in order to progress through the EB-5 process and obtain conditional permanent resident status, the EB-5 investor must either adjust status by <a href=\"https:\/\/eb5affiliatenetwork.com\/485-application-change-status\/\" target=\"_blank\" rel=\"noopener\">filing Form I-485<\/a> or undergo consular processing. This will depend on whether the EB-5 investor is residing in the United States or living overseas at the time the I-526E petition is approved. Once adjustment of status or consular processing has been successfully completed, the EB-5 investor and any derivative beneficiaries will be granted <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-conditional-permanent-resident-status\/\" target=\"_blank\" rel=\"noopener\">conditional permanent resident status<\/a>.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/LldhKu4KCnQ?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Adjustment of Status<\/h3>\n<p>Due to a provision enacted by the <a href=\"https:\/\/eb5affiliatenetwork.com\/changes-to-the-eb-5-industry-under-the-eb-5-reform-and-integrity-act\/\" target=\"_blank\" rel=\"noopener\">2022 EB-5 Reform and Integrity Act<\/a>, certain EB-5 investors may be eligible for Concurrent Filing of Forms I-526E and I-485. Specifically, EB-5 investors who are already working and residing in the United States under valid non-resident visas, including the H-1B, E-2 and F-1 visas, may simultaneously file for adjustment of status when filing Form I-526E. This will allow the investor to enjoy the benefits of lawful permanent resident status while waiting for their I-526E petition to be adjudicated. However, an EB-5 investor whose country of chargeability is currently <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-priority-dates\/visa-retrogression\" target=\"_blank\" rel=\"noopener\">subject to visa retrogression<\/a> would not be eligible for <a href=\"https:\/\/eb5visainvestments.com\/2022\/03\/14\/eb-5-concurrent-filing-will-let-investors-live-work-and-study-in-the-united-states-sooner-than-before-with-an-eb-5-investment\/\" target=\"_blank\" rel=\"noopener\">EB-5 Concurrent Filing<\/a>.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-262_image-2.jpg\" \/><br \/>\nGenerally prepared with the guidance of an immigration attorney, Form I-485 has a filing fee of $1,440, which already includes the biometrics service fee.<\/p>\n<h3>Consular Processing<\/h3>\n<p>Consular processing consists of two parts: <a href=\"https:\/\/eb5affiliatenetwork.com\/ds-260-application\/\" target=\"_blank\" rel=\"noopener\">filing Form DS-260<\/a> and attending an interview at the local U.S. embassy or consulate office. Once their I-526E petition has been approved, the EB-5 investor will be contacted by the National Visa Center and supplied with instructions on the necessary documentation they must provide as well as the scheduling of their interview.<br \/>\nForm DS-260 must be filed separately by the EB-5 investor and each eligible derivative beneficiary. As with Form I-485, an immigration attorney may file the form for the applicant. The interview will determine the EB-5 investor\u2019s admissibility to the United States.
