The worker would have to meet strict visa requirements, visa numbers are limited, and the position will not count toward the EB-5 job creation requirements if the person holds a <a href=\"https:\/\/eb5affiliatenetwork.com\/nonimmigrant-visas\/\" target=\"_blank\" rel=\"noopener\">nonimmigrant visa<\/a>.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/S4x0n2ASrMI?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nThe process for a business to sponsor a foreign worker is complex. Although it is understandable that EB-5 investors who come from around the world may want to partner with someone they know well, and even though there are several vise pathways for the EB-5 business to sponsor the foreign worker, there are strict requirements for the worker&#8217;s qualification in addition to limited visa availability .<br \/>\nFor instance, demand for the H1-B program has historically far exceeded visa supply. Due to the limitations of the H-1B program, many foreign workers looking to reside permanently in the United States choose to <a href=\"https:\/\/eb5visainvestments.com\/2020\/12\/18\/should-h1-b-visa-applicants-leave-eb-5\/\" target=\"_blank\" rel=\"noopener\">pursue the EB-5 investment program<\/a>.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-100_image-2.jpg\" \/><br \/>\nEB-5 businesses are strongly discouraged from sponsoring a foreign worker. Even if a business manages to sponsor a foreign worker successfully, the worker may not be considered a qualified U.S. worker by United States Citizenship and Immigration Services (USCIS), the government body that adjudicates EB-5 petitions. The <a href=\"https:\/\/eb5affiliatenetwork.com\/basics-of-the-eb-5-immigrant-investor-program\/\" target=\"_blank\" rel=\"noopener\">EB-5 investment program<\/a> comes with a long list of requirements, and, among other things, each EB-5 investment must create at least 10 full-time jobs for qualified U.S. workers.<br \/>\n<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-fifth-preference-eb-5\/about-the-eb-5-visa-classification\" target=\"_blank\" rel=\"noopener\">USCIS defines a qualifying employee<\/a> as \u201ca U.S. citizen, lawful permanent resident, or other immigrant authorized to work in the United States, including a conditional resident, temporary resident, asylee, refugee, or a person residing in the United States under suspension of deportation.\u201d The definition specifically excludes the investor and their family members, anyone holding nonimmigrant status (such as an <a href=\"https:\/\/eb5affiliatenetwork.com\/h-1b-work-visa\/\" target=\"_blank\" rel=\"noopener\">H-1B nonimmigrant<\/a>), and anyone who has not secured authorization to work in the United States.
