The IPO is the USCIS office that manages the program\u2019s operations and processes EB-5 petitions, including <a href=\"https:\/\/eb5visainvestments.com\/2022\/05\/23\/how-to-prepare-for-and-submit-form-i526\/\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a>\u2014Immigrant Petition by Regional Center Investor.<\/p>\n<h3>Priority Date<\/h3>\n<p>When USCIS receives an EB-5 investor\u2019s petition, the agency sends out a receipt notice. This serves to confirm that the agency has received the petition and provides the investor with their priority date\u2014the date when the petition was received. The priority date is used to determine when the applicant may apply for his or her EB-5 visa. Applicants may check the status of their priority date by viewing the <a href=\"https:\/\/eb5affiliatenetwork.com\/a-guide-to-understanding-the-monthly-visa-bulletin\/\" target=\"_blank\" rel=\"noopener\">monthly visa bulletin<\/a>.<\/p>\n<h3>Visa Availability<\/h3>\n<p>I-526E petitions are processed based on visa availability. There are a limited number of visas available each fiscal year, and countries with high demand\u2014such as China, India, and Vietnam\u2014have historically experienced backlogs. The EB-5 Reform and Integrity Act of 2022, signed into law by President Biden, introduced an initiative to try to remedy that\u2014<a href=\"https:\/\/eb5visainvestments.com\/2022\/06\/03\/reserved-eb-5-visas-under-the-reform-and-integrity-act-of-2022\/\" target=\"_blank\" rel=\"noopener\">reserved visas<\/a>.<\/p>\n<h3>Reserved Visas<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-297_image-2.jpg\" \/><br \/>\nThe reserved visas are meant to improve processing times for high-demand nationalities. The Department of State (DOS) will reserve 32% of the yearly visa pool\u2014which is approximately 20,000 in 2022\u2014for applicants who invest in <a href=\"https:\/\/eb5visainvestments.com\/2022\/09\/06\/why-you-should-invest-in-an-eb-5-targeted-employment-area-project\/\" target=\"_blank\" rel=\"noopener\">targeted employment areas (TEAs)<\/a>.<br \/>\nThere will be <a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/15\/may-2022-visa-bulletin-includes-reserved-visa-pools-new-chinese-eb-5-investors-can-effectively-skip-the-line\/\" target=\"_blank\" rel=\"noopener\">three categories<\/a> of projects for reserved visas\u2014high unemployment, rural and infrastructure. Any new EB-5 investors who put the <a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/26\/what-is-the-minimum-eb-5-investment-amount\/\" target=\"_blank\" rel=\"noopener\">minimum investment amount<\/a> of $800,000 at risk in any of these three categories will be given priority processing. Reserved visas are also given to the family members of EB-5 applicants who are traveling with them, known as derivative beneficiaries.
