Each month, the agency publishes whether the \u201cdate for filing\u201d or the \u201cfinal action date\u201d may be used to determine if Form I-485 may be filed.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/vPBXcuy9yzg?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>If USCIS determines that the number of visas available in a fiscal year exceeds that of the known applicants for such visas\u2014such as EB-5\u2014the agency will state that the \u201cdate for filing\u201d may be used. Otherwise, the agency will state that the \u201cfinal action date\u201d should be used. In either case, EB-5 investors should use the information that was published in the latest <a href=\"https:\/\/eb5affiliatenetwork.com\/a-guide-to-understanding-the-monthly-visa-bulletin\/\" target=\"_blank\" rel=\"noopener\">Visa Bulletin<\/a>.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-174_image-2.jpg\" \/><\/p>\n<p>EB-5 investors who wish to file for an Adjustment of Status should contact their immigration attorney for guidance in the process. The window to file Form I-485 is time-sensitive, and it is in the investor\u2019s best interest to obtain the most up-to-date information so as not to delay the process any further.<\/p>\n<p>As of March 2022, EB-5 investors who currently reside in the United States\u2014such as those with H-1B visas\u2014may <a href=\"https:\/\/eb5visainvestments.com\/2022\/03\/14\/eb-5-concurrent-filing-will-let-investors-live-work-and-study-in-the-united-states-sooner-than-before-with-an-eb-5-investment\/\" target=\"_blank\" rel=\"noopener\">file Form I-526E and Form I-485 concurrently<\/a>. The passing of the <a href=\"https:\/\/eb5visainvestments.com\/2022\/03\/16\/eb-5-reform-and-integrity-act-of-2022-signed-into-law-regional-center-program-reauthorized\/\" target=\"_blank\" rel=\"noopener\">EB-5 Reform and Integrity Act<\/a> brought about this and many other changes in the industry. Prior to the Reform and Integrity Act, EB-5 investors had to wait for their <a href=\"https:\/\/eb5affiliatenetwork.com\/i-526-petition\/\" target=\"_blank\" rel=\"noopener\">I-526E petitions<\/a> to be approved before filing Form I-485. Not only did this take additional time, but investors had to maintain their status on a separate visa to remain in the United States. Concurrent filing offers EB-5 investors greater flexibility and reduced waiting times.
