The passing of these bills into law has had significant consequences for prospective EB-5 investors from Hong Kong seeking to relocate to the United States. In essence, the Executive Order has made it so that <a href=\"https:\/\/eb5visainvestments.com\/2020\/09\/14\/eb-5-backlog-for-china-now-includes-hong-kong-investors\/\" target=\"_blank\" rel=\"noopener\">Hong Kong is treated the same as China<\/a>, particularly with regards to immigration. As such, EB-5 investors from Hong Kong will have their country of chargeability deemed as the People\u2019s Republic of China and see their previous visa availability retrogress from \u201ccurrent\u201d to the priority date of Chinese EB-5 investors. Because China is currently <a href=\"https:\/\/eb5affiliatenetwork.com\/current-trends-in-the-chinese-eb-5-market\/\" target=\"_blank\" rel=\"noopener\">in retrogression and facing significant backlog<\/a> and lengthy processing times as a result of oversubscription, prospective EB-5 investors from Hong Kong will now also have to wait several years to finish applying for an EB-5 visa.<br \/>\nThe Executive Order has also removed Hong Kong from the list of eligible participating countries in the <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-through-the-diversity-immigrant-visa-program\" target=\"_blank\" rel=\"noopener\">Diversity Visa Lottery<\/a> and Visa Waiver Program.<br \/>\nWhile Chinese nationals from Taiwan and Macau are not subject to the <a href=\"https:\/\/eb5visainvestments.com\/faq\/china-retrogression\/why-do-mainland-china-eb-5-applicants-face-a-longer-wait-time-to-receive-their-conditional-green-cards\/\" target=\"_blank\" rel=\"noopener\">EB-5 visa retrogression<\/a> facing those from Mainland-China, EB-5 investors from Hong Kong must now confront the same host of issues as their Mainland counterparts.
