The <a href=\"https:\/\/eb5visainvestments.com\/faq\/troubleshooting-problems\/what-is-the-immigrant-investor-program-office-ipo-and-how-is-it-different-from-the-california-service-center-csc\/\" target=\"_blank\" rel=\"noopener\">Immigrant Investor Program Office (IPO)<\/a> is the office within U.S. Citizenship and Immigration Services (USCIS) that is responsible for overseeing the EB-5 program and adjudicating EB-5 petitions, including Form I-526E.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/JrBfS6JNadM?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nBefore March 31, 2020, USCIS (or the IPO) adjudicated I-526E petitions on a first-in, first-out basis. In other words, the IPO adjudicated these petitions in the order in which it received them. In 2020, USCIS changed to a <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-fifth-preference-eb-5\/questions-and-answers-eb-5-immigrant-investor-program-visa-availability-approach\" target=\"_blank\" rel=\"noopener\">\u201cvisa availability\u201d approach<\/a>: the IPO first processes petitions from investors for whom a visa is available or for whom a visa will soon be available. However, it does still <a href=\"https:\/\/eb5visainvestments.com\/2020\/04\/28\/impact-of-eb-5-visa-availability-approach-by-country\/\" target=\"_blank\" rel=\"noopener\">honor expedite requests<\/a> regardless of the availability of visas for the petitioner\u2019s country of birth.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2022\/12\/FAQ-16_image-2.jpg\" \/><br \/>\nUSCIS bases its visa availability decisions on information published in the Department of State <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/visa-law0\/visa-bulletin.html\" target=\"_blank\" rel=\"noopener\">Monthly Visa Bulletin<\/a>. Form I-526E lists the investor\u2019s country of birth, which is compared to Chart B of the Visa Bulletin, which shows whether visas are available for that country. Until a visa becomes available, the petition will be listed as pending. If an investor wants to gauge when their petition might be processed, they can visit the <a href=\"https:\/\/egov.uscis.gov\/processing-times\/\" target=\"_blank\" rel=\"noopener\">USCIS Processing Times page<\/a>. They can also use the <a href=\"https:\/\/egov.uscis.gov\/casestatus\/landing.do\" target=\"_blank\" rel=\"noopener\">Case Status Online<\/a> portal to follow up on the status of their case.<br \/>\nThe <a href=\"https:\/\/eb5affiliatenetwork.com\/what-the-new-uscis-i-526-petition-processing-approach-means-for-applicants\/\" target=\"_blank\" rel=\"noopener\">visa availability approach benefits<\/a> EB-5 investors from countries with visas available, as it can shorten the adjudication queue. Additionally, it benefits petitioners from countries experiencing backlogs who have children who are at risk of aging out of the program. The number of days the petition remained pending is subtracted from the child\u2019s age once the petition is adjudicated, which means the child\u2019s age is effectively \u201cfrozen\u201d while the petition remains pending.
