This is a requirement for any dependent children, biological or otherwise, who the EB-5 investor wishes to attach to their <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-fifth-preference-eb-5\/about-the-eb-5-visa-classification\" target=\"_blank\" rel=\"noopener\">EB-5 visa application<\/a>.<br \/>\nThe Immigration and Nationality Act (INA) offers <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-h-chapter-2\" target=\"_blank\" rel=\"noopener\">two definitions of \u201cchild\u201d<\/a>. While the definition used for naturalization and citizenship excludes stepchildren, the definition used for visa and visa petition purposes, including the EB-5 visa, includes stepchildren as long as they fulfill certain conditions. According to United States Citizenship and Immigration Services (USCIS), the <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-6-part-b-chapter-8\" target=\"_blank\" rel=\"noopener\">official definition of a \u201cchild\u201d<\/a> for immigration purposes is an unmarried person under the age of 21.<br \/>\n<img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-63090\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2.jpg\" alt=\"\" width=\"852\" height=\"502\" srcset=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2.jpg 852w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-300x177.jpg 300w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-350x206.jpg 350w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-500x295.jpg 500w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-380x224.jpg 380w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-24x14.jpg 24w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-36x21.jpg 36w, https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-242_image-2-48x28.jpg 48w\" sizes=\"(max-width: 852px) 100vw, 852px\" \/><br \/>\nSecond, the stepchild must have been under the age of 18 when the marriage between their biological parent and the EB-5 investor took place. This would constitute a qualifying step-relationship between the EB5 investor and their stepchild. The stepchild would most likely not be able to be considered the legal child of the EB-5 investor or stepparent if their biological parent divorces or separates from the EB-5 investor, or if either parent dies.<br \/>\nThird, to include their stepchild as a derivative beneficiary, the EB-5 investor must append certain documentation to <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">their I-526E petition<\/a>. These documents will likely include, but are not limited to, marriage certificates, birth certificates, divorce decrees, or death certificates.
