Trips that last longer than a year can lead United States Citizenship and Immigration Services (USCIS) to conclude that the person has <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-d-chapter-2#:~:text=Abandonment%20of%20LPR%20status%20occurs,the%20parent's%20custody%20and%20control.\" target=\"_blank\" rel=\"noopener\">abandoned their LPR status<\/a>. The key issue is the person\u2019s intent to make the United States their permanent residence.<br \/>\nUSCIS considers <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-d-chapter-2\" target=\"_blank\" rel=\"noopener\">several factors<\/a> when determining a person\u2019s intent to permanently reside in the United States.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/2F9YJ1pY3EU?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nThese include<\/p>\n<ul>\n<li>maintaining property and business affiliations in the United States,<\/li>\n<li>filing federal and state income taxes as a U.S. permanent resident, and<\/li>\n<li>familial ties to the United States.<\/li>\n<\/ul>\n<p>When traveling, it is the responsibility of the LPR to demonstrate intent to return and permanently reside in the United States. It is recommended that the individual apply for a <a href=\"https:\/\/www.uscis.gov\/forms\/explore-my-options\/travel-outside-the-us-as-a-permanent-resident#:~:text=If%20you%20are%20in%20the,the%20U.S.%20for%20humanitarian%20reasons).\" target=\"_blank\" rel=\"noopener\">re-entry permit<\/a> before traveling outside of the United States. This will show USCIS the reason for the trip and an approximation of how long the individual will be abroad. This can help tremendously in demonstrating an intent to return within a reasonable timeframe.<br \/>\nThe turnkey characteristic of the EB-5 investment program is the pathway to U.S. permanent resident status. Once an EB-5 investor\u2019s <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">Form I-526E petition<\/a> is approved, they\u2014and their <a href=\"https:\/\/eb5visainvestments.com\/2020\/09\/14\/how-can-an-eb-5-investor-receive-u-s-green-cards-for-their-family\/\" target=\"_blank\" rel=\"noopener\">qualifying family members<\/a>\u2014can relocate to the United States and enjoy the benefits of LPR status. However, their LPR status is on a conditional, two-year basis.
