There are a number of factors they assess that EB-5 investors should be mindful of when <a href=\"https:\/\/www.uscis.gov\/i-829\" target=\"_blank\" rel=\"noopener\">filing their I-829 petition<\/a>.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/LjtAEKEsHUk?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nThe most important factor is adherence to the criteria set out by the EB-5 program. In accordance with the program\u2019s rules and regulations, there must be evidence that a <a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/26\/what-is-the-minimum-eb-5-investment-amount\/\" target=\"_blank\" rel=\"noopener\">qualifying EB-5 investment<\/a> was made. As of March 2022, the qualifying investment amounts are $1,050,000 and $800,000, the latter if investing in a project located in a <a href=\"https:\/\/eb5affiliatenetwork.com\/eb-5-tea-map\/\" target=\"_blank\" rel=\"noopener\">targeted employment area (TEA)<\/a>. There must also be proof that the investment was made into an eligible new commercial enterprise (NCE). To that end, the investor should append certain relevant documentation to their I-829 petition, such as the NCE\u2019s legal permits and licenses to operate, any contracts, and tax returns.<br \/>\nUSCIS will also verify whether the EB-5 investor\u2019s investment generated at least 10 full-time jobs within the project or business. This can be validated through documentation such as tax and payroll records from the NCE. The <a href=\"https:\/\/eb5visainvestments.com\/2021\/12\/17\/employment-creation-in-the-eb-5-program\/\" target=\"_blank\" rel=\"noopener\">job creation quota<\/a> is calculated differently for direct EB-5 projects and those sponsored by regional centers. While direct EB-5 investors are permitted only to count direct employment toward their quota, regional center investors are permitted to also count <a href=\"https:\/\/eb5affiliatenetwork.com\/project-developer-faq-topics\/direct-vs-regional-center-projects\/direct-indirect-induced-jobs\/\" target=\"_blank\" rel=\"noopener\">indirect and induced employment<\/a> toward their tally.<br \/>\n<img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-166_image-2.jpg\" \/><br \/>\nTo an extent, USCIS will also look at compliance with the <a href=\"https:\/\/eb5affiliatenetwork.com\/how-to-create-a-strong-business-plan-for-your-eb-5-project\/\" target=\"_blank\" rel=\"noopener\">EB-5 investor\u2019s original business plan<\/a>, though minor tweaks of a superficial nature may be acceptable. There will also be a section for personal information. If the EB-5 investor or any of their derivative beneficiaries have a criminal record, this must be recorded on the petition. If the primary applicant has passed away and the new petitioner is a family member, this information must also be noted.<br \/>\nThe I-829 petition will be subject to high levels of scrutiny by USCIS.
