If a couple is not married due to the laws in their home country\u2014as is sometimes the case with same-sex couples\u2014the solution is to get married in a nation that legally recognizes their union. USCIS recognizes an EB-5 investor\u2019s spouse as a derivative beneficiary as long as they were married in a place where the marriage is legally recognized.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/dn4XFoT3voU?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Derivative Beneficiaries<\/h3>\n<p>The <a href=\"https:\/\/eb5visainvestments.com\/abouteb5\/#process\" target=\"_blank\" rel=\"noopener\">EB-5 visa process<\/a> allows the immediate family of an EB-5 investor\u2014their spouse and <a href=\"https:\/\/eb5visainvestments.com\/2022\/09\/02\/the-benefits-of-the-eb-5-visa-program-for-investors-with-children\/\" target=\"_blank\" rel=\"noopener\">unmarried children under the age of 21<\/a>\u2014to also receive permanent resident status upon adjudication of <a href=\"https:\/\/eb5visainvestments.com\/2022\/07\/12\/uscis-releases-new-form-i-526e-eb-5-regional-center-investor-initial-green-card-application-form\/\" target=\"_blank\" rel=\"noopener\">Form I-526E<\/a>. Derivative beneficiaries are only able to receive permanent resident status by way of their connection to the primary applicant which, in the case of the EB-5 visa, is the EB-5 investor.<br \/>\nDerivative beneficiaries must go through the same <a href=\"https:\/\/eb5visainvestments.com\/2022\/06\/17\/checklist-and-timeline-for-securing-a-us-green-card\/\" target=\"_blank\" rel=\"noopener\">checklist items for a U.S. green card<\/a> as the primary applicant. They must submit the same paperwork, pay fees, pass a medical examination, and participate in an interview. Usually, visas are valid for a period of six months. While it is recommended that the EB-5 investor and their immediate family travel to the United States at the same time, the primary applicant may travel any time before their derivatives.
