Instead, the agency went straight to denial\u2014an unusually severe step that underscores the seriousness of the issue.<\/p>\n<p>What mistake did these investors make? Each investor used loaned funds from an entity controlled by the same regional center sponsoring their EB-5 project.<\/p>\n<p>This practice, which may be presented as a convenient solution for investors short on funds, directly violates USCIS policy. And the consequences are serious for EB-5 applicants: <a href=\"https:\/\/eb5visainvestments.com\/faq\/troubleshooting-problems\/what-are-the-most-common-reasons-an-eb-5-petition-might-be-delayed-or-denied\/\" target=\"_blank\" rel=\"noopener\">denial of their I-526E petition<\/a> and, effectively, the loss of the investor\u2019s U.S. immigration process.<\/p>\n<p>As <a href=\"https:\/\/selectgm.com\/attorneys\/anahita-george\/\" target=\"_blank\" rel=\"noopener\">Anahita George, Esq<\/a>, explains, \u201cWe are now seeing denials that leave no room for interpretation\u2014if even part of your EB-5 capital comes from a loan tied to the regional center, your case will be denied. USCIS has made this point with absolute clarity.\u201d<\/p>\n<p>Even though USCIS may have approved similar I-526Es in the past, the agency is evidently realizing that this is a clear violation of EB-5 policy. We strongly caution all EB-5 investors against using funds loaned from a regional center or from a related entity.<\/p>\n<p>Doing so will put you on the path to a swift USCIS denial.<\/p>\n<p>Moreover, regional centers that offer such loans are not only showing clear disregard for USCIS policy\u2014they are also putting their investors\u2019 immigration outcomes at risk, likely for the sake of gaining faster access to capital.<\/p>\n<p>In this post, we\u2019ll examine how these circular loans from regional centers violate multiple rules of the EB-5 program and why the agency is taking such strong measures against these loan arrangements. We\u2019ll then explore how EB-5 investors can avoid these risky projects and the steps to take for investors who have already received an I-526E denial.<\/p>\n<div class=\"form-guide\">\n<h6 id=\"heading1\"><a href=\"#h1\">The Source-of-Funds Requirement in EB-5<\/a><\/h6>\n<ul class=\"form-guide-list\">\n<li id=\"subheading2\"><a href=\"#h2\">What the Law Says<\/a><\/li>\n<\/ul>\n<h6 id=\"heading1\"><a href=\"#h3\">USCIS Specifically Prohibits Loans fFom Regional Centers<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h4\">The Risks for EB-5 Investors<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h5\">How USCIS Views These Circular Loans<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h6\">How EB-5 Investors Can Avoid USCIS Denials<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h7\">Protect Your Immigration Goals\u2014Avoid Loans From Regional Centers<\/a><\/h6>\n<\/div>\n<h3 id=\"h1\">The Source-of-Funds Requirement in EB-5<\/h3>\n<p>Every EB-5 investor must prove that their investment funds are <a href=\"https:\/\/eb5affiliatenetwork.com\/understanding-eb-5-source-of-funds-requirements\/\" target=\"_blank\" rel=\"noopener\">lawfully sourced and personally owned<\/a>. This is not just a formality\u2014it is one of the most crucial parts of the EB-5 process. USCIS carefully traces the path of every dollar to ensure compliance.<\/p>\n<p>If USCIS identifies problems with an investor\u2019s <a href=\"https:\/\/eb5visainvestments.com\/2024\/10\/17\/additional-considerations-when-proving-eb-5-source-of-funds\/\" target=\"_blank\" rel=\"noopener\">source of funds<\/a>, the likely outcome is an RFE, a NOID, or outright denial.<\/p>\n<p>In the recent cases at issue, USCIS has skipped the intermediate steps and went straight to denial\u2014demonstrating just how serious the violations were.<\/p>\n<p>Sam Silverman, managing partner of EB5AN, notes, \u201cThe message is crystal clear. USCIS will not tolerate EB-5 investments that include money loaned from regional centers or their affiliates. Investors must wholly own the funds they invest.\u201d<\/p>\n<p>Consider why it\u2019s so important for EB-5 applicants to invest with their own funds.<\/p>\n<h4 id=\"h2\">What the Law Says<\/h4>\n<p>The <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title8-section1153&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">Immigration and Nationality Act<\/a> (INA) sets strict rules for gifted or loaned funds. Under the subsection \u201cGift and loan restrictions, section 203(b)(5)(L)(iii) of the INA says the following:<\/p>\n<p><i>(I) In general<br \/>\nGifted and borrowed funds may not be counted toward the minimum capital investment requirement under subparagraph (C) unless such funds-<br \/>\n<span style=\"padding-left: 20px;\">(aa) were gifted or loaned to the alien investor in good faith; and<\/span><br \/>\n<span style=\"padding-left: 20px;\">(bb) were not gifted or loaned to circumvent any limitations imposed on permissible sources of capital under this subparagraph, including but not limited to proceeds from illegal activity.<\/span><i><\/i><\/i><\/p>\n<p>In other words, <a href=\"https:\/\/eb5visainvestments.com\/faq\/source-of-funds\/can-a-loan-used-to-fund-an-eb-5-investment-be-repaid-early\/\" target=\"_blank\" rel=\"noopener\">EB-5 investors can use loaned funds<\/a> only if the loan is in good faith, not designed to evade program rules, and not sourced from impermissible entities. Since they do not meet the third of these standards, loans from regional centers or their controlled entities fail this test.<\/p>\n<p>Suppose an investor has chosen to invest in a <a href=\"https:\/\/eb5visainvestments.com\/2025\/07\/23\/what-targeted-employment-areas-mean-for-eb-5-investors\/\" target=\"_blank\" rel=\"noopener\">targeted employment area project<\/a> to qualify for the lower investment threshold of $800,000. Now suppose the regional center sponsoring this project offers to loan the investor $300,000 as part of their $800,000 investment amount.<\/p>\n<p>The regional center\u2019s goal may be for the investor to file their Form I-526E as quickly as possible and gain faster access to the funds. But based on EB-5 program rules, the investor will not be reaching the $800,000 minimum investment amount. The investor is only investing $500,000\u2014the remaining $300,000 is the regional center\u2019s own capital, simply being recycled into another EB-5 project.<\/p>\n<p>This is a clear attempt to \u201cgame the system\u201d and, as the INA puts it, \u201ccircumvent [limitations] imposed on permissible sources of capital.\u201d<\/p>\n<h4>Partial Investments<\/h4>\n<p>What about <a href=\"https:\/\/eb5visainvestments.com\/2023\/12\/26\/starting-an-eb-5-investment-with-a-partial-payment-of-less-than-800k-weighing-the-pros-and-cons\/\" target=\"_blank\" rel=\"noopener\">partial EB-5 investments<\/a>, you may be wondering, where the investor contributes part of their $800,000 amount and then pledges to repay the rest by a specified date?<\/p>\n<p>In most instances of partial investments, the investor\u2019s remaining funds are usually secured by some form of collateral, and the investor is the sole provider of the invested funds\u2014none of the investment can come from the regional center\u2019s funds, which were likely derived from other EB-5 investors.<\/p>\n<p>Put simply, whether using a partial or full investment, the investor must be the sole provider of all invested funds.<\/p>\n<h3 id=\"h3\">USCIS Specifically Prohibits Loans From Regional Centers<\/h3>\n<p>USCIS policy makes it clear: Funds loaned by a regional center or any affiliated entity do not count as EB-5 capital.<\/p>\n<p>INA \u00a7203(b)(5)(D)(ii)(III) explicitly excludes \u201ccapital invested in exchange for a note, bond, convertible debt, obligation, or any other debt arrangement between the alien investor and the new commercial enterprise.\u201d<\/p>\n<p>In EB-5 capital, the <a href=\"https:\/\/eb5visainvestments.com\/2025\/08\/21\/eb-5-program-terminology-explained\/#:~:text=to%20maintain%20compliance.-,NCE%20(New%20Commercial%20Enterprise),-A%20new%20commercial\" target=\"_blank\" rel=\"noopener\">new commercial enterprise<\/a> (NCE) is the regional center\u2019s investment fund set up for the EB-5 project. Naturally, the above restriction would also apply to any related entities.<\/p>\n<p>These could be affiliates or so-called \u201cthird-party\u201d entities that are in fact controlled by the same principals as the regional center. That\u2019s why it\u2019s crucial for investors to find out whether any entity offering a loan is linked to the regional center.<\/p>\n<p>\u201cWhen funds are loaned by the regional center itself,\u201d Anahita George explains, \u201cthose funds often come from earlier EB-5 investors. That means no new capital is being introduced to the project\u2014and <a href=\"https:\/\/eb5visainvestments.com\/2025\/06\/27\/why-job-creation-matters-the-key-difference-between-eb-5-and-traditional-investment-visas\/\" target=\"_blank\" rel=\"noopener\">no new jobs are being created<\/a>. USCIS considers this a circular transaction, and it is not allowed.\u201d<\/p>\n<h3 id=\"h4\">The Risks for EB-5 Investors<\/h3>\n<p>Accepting a loan from a regional center-controlled entity exposes investors to several risks:<\/p>\n<ol>\n<li><strong>Outright Denial of their I-526E Petition<\/strong>: USCIS adjudicators view these arrangements as a blatant violation. In multiple recent cases, investors\u2019 petitions were denied without RFEs or NOIDs.<\/li>\n<li><strong>Loss of Immigration Benefits<\/strong>: Without an approved I-526E, the investor and their family cannot <a href=\"https:\/\/eb5visainvestments.com\/8-reasons-to-invest-in-u-s-permanent-residency-through-the-eb-5-program\/\" target=\"_blank\" rel=\"noopener\">proceed to Green Cards<\/a>. Years of planning and financial commitment may be wasted. And if you are already residing in the U.S., you may have to leave on short notice.<\/li>\n<li><strong>Losing Funds in a Ponzi-Like Scheme<\/strong>: These arrangements often involve recycling funds already in the NCE. The SEC defines a Ponzi scheme as \u201can investment fraud that pays existing investors with funds collected from new investors.\u201d Circular EB-5 loans share a dangerous resemblance to such schemes and make it unlikely for the EB-5 investors to be repaid.<\/li>\n<\/ol>\n<p>\u201cIf a regional center is offering you a loan to cover your EB-5 capital,\u201d Silverman warns, \u201cthat <a href=\"https:\/\/eb5visainvestments.com\/2023\/07\/02\/eb-5-investment-transparency-a-guide-to-understanding-risks-and-identifying-red-flags\/\" target=\"_blank\" rel=\"noopener\">is a clear red flag<\/a>. They are putting their access to your money ahead of your immigration success.\u201d<\/p>\n<h3 id=\"h5\">How USCIS Views These Circular Loans<\/h3>\n<p>The recent I-526E denials show just how seriously USCIS takes this issue. Some of these denials have been over 60 pages long, listing in detail how loans from regional centers fail to comply with USCIS rules.<\/p>\n<p>USCIS is sending a clear message: EB-5 capital must come from the investor and the investor alone. Any attempt to \u201cgame the system\u201d with third-party funds will likely <a href=\"https:\/\/eb5affiliatenetwork.com\/common-causes-of-eb-5-petition-denial-and-how-to-avoid-them\/\" target=\"_blank\" rel=\"noopener\">receive an outright denial<\/a>.<\/p>\n<p>In a prior EB5AN article, \u201c<a href=\"https:\/\/eb5visainvestments.com\/2025\/05\/20\/eb-5-investors-never-accept-a-loan-from-a-regional-center-avoid-an-i-526e-denial-and-losing-your-funds\/\" target=\"_blank\" rel=\"noopener\">EB-5 Investors, Never Accept a Loan From a Regional Center<\/a>,\u201d we warned investors about the compliance problems tied to loans from regional centers. Those predictions have now come true.<\/p>\n<p>Consider these points from our previous article, which USCIS has likely indicated in its recent I-526E denials:<\/p>\n<ul>\n<li><strong>Circular Capital<\/strong>: Funds are originating within the NCE itself. This is not a good-faith loan\u2014it is a recycling of existing capital.<\/li>\n<li><strong>No Job Creation<\/strong>: Because no new capital enters the project, no new jobs are created from the investor\u2019s contribution.<\/li>\n<li><strong>Funds Not at Risk<\/strong>: The funds were never truly owned by the investor, so they cannot be considered \u201c<a href=\"https:\/\/eb5visainvestments.com\/2025\/05\/09\/what-eb-5-investors-need-to-know-about-the-at-risk-requirement\/\" target=\"_blank\" rel=\"noopener\">at risk<\/a>\u201d as required by EB-5 rules.<\/li>\n<li><strong>Unacceptable Source of Funds<\/strong>: The source-of-funds paper trail would lead back to earlier investors\u2014something USCIS will not accept.<\/li>\n<\/ul>\n<p>Each of these problems on its own could trigger an RFE, a NOID, or a denial. Together, they all but guarantee it.<\/p>\n<h3 id=\"h6\">How EB-5 Investors Can Avoid USCIS Denials<\/h3>\n<p>The key is for investors to do their <a href=\"https:\/\/eb5visainvestments.com\/2025\/08\/26\/using-ai-to-vet-eb-5-regional-centers-what-to-ask-and-how-to-interpret-the-answers\/\" target=\"_blank\" rel=\"noopener\">research on any regional center<\/a> and EB-5 project before investing and make sure they invest using their own funds.<\/p>\n<p>If a regional center\u2014or an affiliated third party\u2014offers you a loan to complete your $800,000 investment, avoid them. This is not the same as a permissible partial investment.<\/p>\n<p>Instead, choose only regional centers that <a href=\"https:\/\/eb5visainvestments.com\/2024\/07\/17\/eb5an-receives-i-956-approvals-for-all-of-its-regional-centers-raising-industry-standard-for-uscis-compliance\/\" target=\"_blank\" rel=\"noopener\">prioritize compliance with USCIS rules<\/a> and that never put investors\u2019 immigration outcomes at risk.<\/p>\n<p>What if you have already invested in such a project and received a denial?
