A percentage cap restricts the number of visas that can be allotted to the <a href=\"https:\/\/eb5affiliatenetwork.com\/eb5-visa\/eb5-visa-program-overview\/\" target=\"_blank\" rel=\"noopener\">EB-5 program<\/a> as well as to each country within the total EB-5 quota.<\/p>\n<p>As the popularity of the EB-5 program continues to grow among <a href=\"https:\/\/eb5visainvestments.com\/2023\/04\/17\/an-overview-of-the-top-10-eb-5-investor-markets-for-2022\/\" target=\"_blank\" rel=\"noopener\">global investors<\/a>, the limited per-country share of EB-5 visas means that investors from high-demand countries may have to wait for a long time before a visa becomes available to them.<\/p>\n<p>Understanding the availability and processing times of EB-5 visas is crucial for investors to make informed decisions about their immigration plans. Investing in certain <a href=\"https:\/\/eb5visainvestments.com\/2022\/02\/11\/what-is-a-targeted-employment-area-and-why-should-you-invest-in-an-eb-5-project-in-a-tea\/\" target=\"_blank\" rel=\"noopener\">targeted employment area (TEA) projects<\/a> could give applicants access to a surplus visa supply and much faster processing than other standard investments. <\/p>\n<p>Given the <a href=\"https:\/\/eb5visainvestments.com\/2023\/06\/02\/the-eb-5-visa-minimum-investment-amount-and-requirements-for-2024\/\" target=\"_blank\" rel=\"noopener\">substantial investment requirement<\/a> of the EB-5 program, investors must be aware of the visa availability and expected <a href=\"https:\/\/eb5visainvestments.com\/2024\/05\/22\/what-you-need-to-know-about-the-new-eb-5-processing-times\/\" target=\"_blank\" rel=\"noopener\">processing time<\/a> of their application before they make a financial commitment to an EB-5 project.<\/p>\n<p>In this article, we will discuss how annual EB-5 visa availability is estimated. We will also explore investment options that offer Green Cards to investors in a short time without any backlog issues.<\/p>\n<div class=\"form-guide\">\n<h6 id=\"heading1\"><a href=\"#h1\">EB-5 Visa Distribution  <\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h2\">The Visa Bulletin<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h3\">Reserved EB-5 Visa Set-Asides<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h4\">Rural TEA vs. High-Unemployment TEA Visa Availability<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h5\">FY 2024 EB-5 Visa Availability in Numbers<\/a><\/h6>\n<h6 id=\"heading2\"><a href=\"#h6\">Secure Your Green Card With EB5AN<\/a><\/h6>\n<\/div>\n<h3 id=\"h1\">EB-5 Visa Distribution <\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2024\/07\/image3-1.jpg\" alt=\"Notebooks, a computer and mouse, and a pen on a desk, with a U.S. Permanent Resident Card (green card) on the top.\"><\/p>\n<p>The Immigration and Nationality Act (INA) sets a <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-and-priority-dates\" target=\"_blank\" rel=\"noopener\">numerical limit to the total number of immigrant visas (Green Cards)<\/a> that the DOS can issue every year to noncitizens seeking permanent residency in the United States. Generally, the annual cap for family-based visas is 226,000, and that for employment-based visas is 140,000.<\/p>\n<p>However, the actual number of employment-based visas available is often more than 140,000, as the unused family-based visas from the previous fiscal year are also added to the total employment-based visa quota in a given year. For instance, <a href=\"https:\/\/travel.state.gov\/content\/dam\/visas\/Statistics\/Immigrant-Statistics\/Web_Annual_Numerical_Limits_FY2024.pdf\" target=\"_blank\" rel=\"noopener\">in FY 2024, the total employment-based visa availability went up to 161,000<\/a> due to the addition of unused visa numbers from FY 2023.<\/p>\n<p>This overall allocation is then divided into five sub-categories within the employment-based category (EB-1 to EB-5), each receiving a certain percentage of the total annual supply.<\/p>\n<p>The EB-5 program receives 7.1% of the employment-based visa quota, i.e., about 10,000 EB-5 visas per year. On top of that, a 7% per-country cap limits the number of visas available to citizens of any one country. This means that regardless of a country&#8217;s population or application volume, only about 700 visas are available per country every year, which includes the primary investors and their family members.<\/p>\n<p>Due to this ceiling, when the demand exceeds the supply of visas for any particular country, it leads to a visa waiting list or backlog. <a href=\"https:\/\/travel.state.gov\/content\/dam\/visas\/Statistics\/Immigrant-Statistics\/WaitingList\/WaitingListItem_2023_vF.pdf\" target=\"_blank\" rel=\"noopener\">Data released by the DOS in November 2023<\/a> showed that 39,883 EB-5 applicants (including principal investors and family derivatives) were awaiting an EB-5 visa, of which 33,676 visa applicants were from China. As we can see, the backlog is severe due to the <a href=\"https:\/\/eb5visainvestments.com\/2024\/02\/29\/chinas-growing-eb-5-visa-demand\/\" target=\"_blank\" rel=\"noopener\">overwhelming demand from Chinese investors<\/a> and annual visa availability constraints.<\/p>\n<h3 id=\"h2\">The Visa Bulletin<\/h3>\n<p>Every month, the DOS publishes a Visa Bulletin to update stakeholders on the <a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/20\/the-benefits-of-living-in-the-united-states-as-a-green-card-holder\/\" target=\"_blank\" rel=\"noopener\">Green Card<\/a> waiting list.<\/p>\n<p>Since the number of immigrants seeking Green Cards almost always exceeds the annual limit, the DOS allocates a <a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/20\/the-benefits-of-living-in-the-united-states-as-a-green-card-holder\/\" target=\"_blank\" rel=\"noopener\">priority date<\/a> to applicants to determine their place in the visa queue.<\/p>\n<p>Applicants can move forward with the immigration process only when the priority date is \u201ccurrent\u201d in their category. <\/p>\n<p>By comparing the cut-off dates published in Visa Bulletin against their priority date, investors can know how far along they are in the queue and <a href=\"https:\/\/eb5visainvestments.com\/2024\/01\/23\/the-ultimate-guide-to-green-card-processing-times\/\" target=\"_blank\" rel=\"noopener\">how much longer it might take before they can get their Green Card<\/a>.<\/p>\n<p>For most countries, the EB-5 visa priority date remains \u00abcurrent,\u00bb meaning there are no backlogs, and visas can be issued soon after the EB-5 petition approval. However, at the time of writing, applicants from China and India are stuck in a backlog, waiting years for their priority date to become \u201ccurrent.\u201d<\/p>\n<p><a href=\"https:\/\/eb5visainvestments.com\/2024\/06\/12\/july-2024-visa-bulletin-no-change-in-eb-5-progress-in-eb-1-for-india-and-worldwide-retrogression-in-eb-3\/\" target=\"_blank\" rel=\"noopener\">As of June 2024<\/a>, the EB-5 unreserved category cut-off date is December 15, 2015 for China and December 1, 2020 for India, indicating that applicants with a priority date later than these dates do not have visa availability.<\/p>\n<p>On the positive side, the EB-5 category has <a href=\"https:\/\/eb5visainvestments.com\/2022\/06\/27\/what-do-eb-5-investors-need-to-know-about-visa-set-asides\/\" target=\"_blank\" rel=\"noopener\">three newly introduced reserved visa sub-categories<\/a> with a \u201ccurrent\u201d priority date for all countries, including China and India. Per the July 2024 Visa Bulletin, these categories have no backlog or waiting list.<\/p>\n<p>Then again, visa availability is not uniform across the three reserved EB-5 sub-categories. Although the Visa Bulletin shows that visas are currently available, <a href=\"https:\/\/eb5visainvestments.com\/2024\/03\/02\/new-uscis-data-major-implications-for-rural-and-urban-eb-5-investor-applications\/\" target=\"_blank\" rel=\"noopener\">data indicates that reserved categories may also become oversubscribed<\/a> even before the backlog is reflected in the Visa Bulletin. Prospective investors must carefully consider future backlog projections in reserved categories and select an investment that promises the best outcome. <\/p>\n<p>Next, we will discuss the visa availability within the reserved EB-5 categories and the best investment options for applicants seeking a <a href=\"https:\/\/eb5visainvestments.com\/2024\/06\/21\/rural-eb-5-investment-a-faster-path-to-u-s-green-cards\/\" target=\"_blank\" rel=\"noopener\">fast-track Green Card<\/a>.<\/p>\n<h3 id=\"h3\">Reserved EB-5 Visa Set-Asides<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2024\/07\/image2-2.jpg\" alt=\"A city skyline and an American flag in the background, with some digital icons in the foreground.\"><\/p>\n<p>The <a href=\"https:\/\/eb5visainvestments.com\/2023\/06\/26\/a-guide-to-understanding-the-eb-5-reform-and-integrity-act-of-2022\/\" target=\"_blank\" rel=\"noopener\">EB-5 Reform and Integrity Act of 2022 (RIA)<\/a> introduced a remarkable provision in the EB-5 program by carving out a 32% reserved set-aside visa quota within the EB-5 category for investments in TEA projects. This measure not only aims to promote EB-5 investments in underserved areas but also presents an opportunity for post-RIA investors to <a href=\"https:\/\/eb5visainvestments.com\/2023\/02\/06\/how-set-aside-visas-can-accelerate-the-eb-5-immigration-process\/\" target=\"_blank\" rel=\"noopener\">skip the long queue in the unreserved category<\/a>. <\/p>\n<p>The breakdown of the reserved set-aside visa percentages is as follows:<\/p>\n<ul>\n<li>20% for investments in rural areas. <\/li>\n<li>10% for investments in areas with high unemployment rates.<\/li>\n<li>2% for investments in specific government-approved infrastructure projects.<\/li>\n<\/ul>\n<p>Set-aside visas are especially beneficial for investors from China and India, as they can now bypass the existing pre-RIA backlog by selecting a reserved category investment. This is an added benefit for rural TEA investors as they get precedence over other EB-5 applicants for visa approval.<\/p>\n<p>The high availability of rural TEA set-aside visas, along with the priority processing of applications, makes <a href=\"https:\/\/eb5visainvestments.com\/2024\/02\/29\/why-invest-in-a-rural-eb-5-project\/\" target=\"_blank\" rel=\"noopener\">rural investments the best choice<\/a> for EB-5 investors seeking a Green Card in the shortest possible time.<\/p>\n<p>In comparison, the high-unemployment TEA category gets a smaller allocation (10%) of the total EB-5 visas. Also, projects in this category have dominated the EB-5 market for a long time and have a high demand among investors. <\/p>\n<p>With more investor interest but smaller visa allocation, the high-unemployment TEA category may already have become oversubscribed. Even though this category is still \u201ccurrent\u201d in the latest Visa Bulletin, it could go into a backlog much sooner than the rural TEA quota.
