One range is assigned to Chinese EB-5 investor applicants, and the other range covers everyone else in the program. Following a shift a few months prior to the <a href=\"https:\/\/eb5visainvestments.com\/2020\/04\/28\/impact-of-eb-5-visa-availability-approach-by-country\/\">visa availability processing approach<\/a>, this split makes sense. The Chinese backlog for EB-5 petitions is substantial, and the country\u2019s investor pool is subject to much longer wait times on I-526 adjudication. <a href=\"https:\/\/egov.uscis.gov\/processing-times\/\">Check the I-526 estimated processing times<\/a> on USCIS\u2019s official website, however, and the clarity ends.<\/p>\n<h3>Who Are the \u201cUnspecified\u201d EB-5 Applicants?<\/h3>\n<p>There you will find not just two estimated processing times, but three. Listed are the Chinese range, the range for investors from everywhere <i>but<\/i> China\u2026 and a third, \u201cunspecified\u201d time range. Your initial thought may be, \u201cIt must be an average of the two,\u201d but simple math says it\u2019s not. USCIS doesn\u2019t offer any explanation or formula, either. In fact, the <a href=\"https:\/\/eb5affiliatenetwork.com\/how-to-calculate-the-eb-5-visa-queue\/\" target=\"_blank\" rel=\"noopener noreferrer\">calculation methodology<\/a> shown on the site doesn\u2019t even appear to have been updated after the change in processing approach. Instead, it reads, \u201cwe generally process cases in the order we receive them.\u201d This is consistent with <a href=\"https:\/\/eb5affiliatenetwork.com\/new-eb-5-visa-availability-approach-for-i-526-petition-processing\/\" target=\"_blank\" rel=\"noopener noreferrer\">the first-in-first-out (FIFO) approach that was replaced<\/a> in the spring of 2020. That isn\u2019t the most concerning inconsistency, however\u2014that\u2019s the issue of reported <a href=\"https:\/\/eb5visainvestments.com\/2020\/08\/06\/the-truth-behind-uscis-processing-time-ranges\/\">case inquiry dates<\/a>.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2020\/09\/image1-2-2.png\" alt=\"how we process cases\" \/><\/p>\n<h3>Is the Wait to <i>Inquire<\/i> About a Wait Time Really So Much Longer Than the Wait Itself?<\/h3>\n<p>According to the USCIS website, EB-5 investors \u2013 whether from China or elsewhere \u2013 are waiting between five and six years before they\u2019re even allowed to <i>inquire<\/i> about an abnormally long I-526 petition processing time. Yet, <a href=\"https:\/\/egov.uscis.gov\/processing-times\/historic-pt\" target=\"_blank\" rel=\"noopener noreferrer\">historical processing data<\/a> for FY2020 puts the average time for I-526 petition adjudication (at least up to June 30) at just over a year (13.7 months).<\/p>\n<p>Furthermore, based on two assumptions, the upper limits for both time ranges aren\u2019t really plausible either. Those assumptions are as follows:<\/p>\n<ul>\n<li>October 2018 case receipt data by country (pulled from site in July 2019) was accurate<\/li>\n<li>The FIFO approach was used for <a href=\"https:\/\/eb5visainvestments.com\/2020\/03\/13\/how-long-does-it-take-for-uscis-to-approve-your-i-526-petition\/\">I-526 processing<\/a> until April 2020<\/li>\n<\/ul>\n<h3>With a Lack of Transparency in Calculations, What Can We Say?<\/h3>\n<p>If the two previous assumptions are true, then USCIS\u2019s global backlog would have also been cleared all the way through April 2017. But if the 54\u201375-month time range for <a href=\"https:\/\/eb5visainvestments.com\/2020\/09\/14\/chinese-eb-5-investors-now-subject-to-separate-estimated-processing-time-range-by-uscis\/\">backlogged Chinese EB-5 investors<\/a> accurately represented current USCIS processing, the receipt date for Chinese I-526 petitions under processing in September 2020 would fall between May 2014 and February 2016\u2014which doesn\u2019t add up. Instead, all these figures seemingly point to USCIS simply not processing Chinese I-526 petitions.<\/p>\n<p>Additionally, if the global backlog should have been cleared through April 2017 accordingly, then new light is shed on USCIS\u2019s 2014 and 2015 case inquiry dates. Assuming the backlog did in fact get cleared, then there aren\u2019t many (if any) EB-5 investors who would actually fall into these case inquiry eligibility date ranges.
