It must be filed within the final 90 days of an investor\u2019s two-year conditional residency period. Upon I-829 approval, the applicant is granted <a href=\"https:\/\/eb5visainvestments.com\/2022\/08\/17\/eb-5-permanent-resident-status-what-eb-5-investors-need-to-know\/\" target=\"_blank\" rel=\"noopener\">U.S. permanent resident status<\/a>. Because I-829 petitions can take several years to process, United States Citizenship and Immigration Services (USCIS) will extend the conditional residency status of investors with pending petitions. Withdrawing an I-829 petition will result in a loss of conditional permanent resident status for the principal applicant and all derivative beneficiaries. An EB5 investor considering withdrawing their I-829 petition should consult with an <a href=\"https:\/\/eb5affiliatenetwork.com\/how-to-choose-an-eb-5-immigration-attorney\/\" target=\"_blank\" rel=\"noopener\">experienced immigration attorney<\/a><a href=\"https:\/\/eb5visainvestments.com\/2022\/04\/26\/the-eb5-green-card-process\/\" target=\"_blank\" rel=\"noopener\"> before making this decision.<\/a><\/p>\n<p>Withdrawing <a href=\"https:\/\/eb5visainvestments.com\/2022\/01\/07\/how-to-gain-approval-for-form-i-829\/\" target=\"_blank\" rel=\"noopener\">an I-829 petition<\/a> before approval may risk an applicant\u2019s investment capital. As part of EB5 program requirements, an investor can only qualify if they put the necessary capital <a href=\"https:\/\/eb5visainvestments.com\/2020\/04\/22\/what-the-eb-5-at-risk-requirement-means\/\" target=\"_blank\" rel=\"noopener\">\u201cat risk\u201d<\/a>; they cannot be guaranteed a return of their funds. Although USCIS allows an investor to receive their funds after filing Form I-829, this is not always the case. Some <a href=\"https:\/\/eb5visainvestments.com\/2022\/06\/08\/what-makes-a-good-eb5-regional-center\/\" target=\"_blank\" rel=\"noopener\">EB5 regional centers<\/a> may prohibit the return of investment capital until after I-829 approval. Such stipulations will be included in a project&#8217;s subscription agreement. If an investor wishes to withdraw their I-829 petition but still reside in the country, they must find a way to maintain lawful U.S. status to avoid issues such as deportation or <a href=\"https:\/\/www.uscis.gov\/laws-and-policy\/other-resources\/unlawful-presence-and-inadmissibility\" target=\"_blank\" rel=\"noopener\">accrual of unlawful presence<\/a>.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-364_image-2.jpg\" \/><\/p>\n<p>There is no official USCIS withdrawal form, so investors must submit a request to withdraw their I-829 petition.
