It is, however, possible to pursue both asylum and an EB-5 visa at the same time. To apply for asylum in the United States, one must <a href=\"https:\/\/www.uscis.gov\/i-589\" target=\"_blank\" rel=\"noopener\">file Form I-589<\/a> within one year of their arrival to the country. Moreover, U.S. immigration law permits asylees to apply for lawful permanent resident status after they have been physically present in the U.S. for at least one year since being granted asylum. In other words, a foreign national can eventually <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-for-asylees\" target=\"_blank\" rel=\"noopener\">obtain a green card through asylum<\/a>.<\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/tWcv8UgFjGs?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Being granted asylum status will give an asylee a long-term right to stay in the United States. However, this right is conditional on the asylee&#8217;s fear of persecution in their home country. If the circumstances in an asylee\u2019s home country change and there is no longer a risk of persecution, the asylee may have to return home. However, once an asylee obtains a green card, this condition doesn\u2019t apply anymore. A foreign national may be concerned that they will be required to return to their home country before they can obtain a green card through asylum. This is where the EB-5 visa comes in; a foreign national seeking asylum may be able to obtain a conditional <a href=\"https:\/\/eb5visainvestments.com\/2022\/07\/14\/who-can-get-an-eb-5-investment-green-card\/\" target=\"_blank\" rel=\"noopener\">green card through EB-5 investment<\/a> faster than they would through asylum.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-200_image-2.jpg\" \/><\/p>\n<p>Although a foreign national seeking asylum may concurrently pursue an EB-5 visa, they must have current nonimmigrant status when <a href=\"https:\/\/eb5visainvestments.com\/an-eb-5-investors-guide-to-form-i-526\/\" target=\"_blank\" rel=\"noopener\">their I-526E petition<\/a> is approved. Otherwise, they will need to return to their home country and <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/consular-processing\" target=\"_blank\" rel=\"noopener\">consular process<\/a> to obtain an EB5 visa. Naturally, this may present issues for an individual who is seeking asylum.
