There are no regulations concerning where the EB-5 investor must file their I-526E petition; it can be done while in the United States, in their home country, or anywhere in the world.<\/p>\n<p>Most EB-5 investors invest through <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-fifth-preference-eb-5\/eb-5-immigrant-investor-regional-centers\/approved-eb-5-immigrant-investor-regional-centers\" target=\"_blank\" rel=\"noopener\">a regional center<\/a> and almost all hire <a href=\"https:\/\/eb5visainvestments.com\/eb-5-immigration-attorneys\/\" target=\"_blank\" rel=\"noopener\">an immigration attorney<\/a> to guide them through the EB-5 process. Before submitting their I-526E petition, the EB-5 investor should make sure they have met a number of requirements to ensure maximum likelihood of having their petition approved by United States Citizenship and Immigration Services (USCIS).<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/01\/FAQ-184_image-2.jpg\" \/><\/p>\n<p>The EB-5 investor must prepare documentation that proves they have made a qualifying minimum investment in an eligible new commercial enterprise (NCE). The current threshold investment amount is $1,050,000, while EB-5 projects with <a href=\"https:\/\/eb5affiliatenetwork.com\/what-is-a-tea-and-why-should-you-make-an-eb-5-investment-in-one\/\" target=\"_blank\" rel=\"noopener\">targeted employment area (TEA)<\/a> designations have a reduced minimum investment amount of $800,000. The EB-5 investor must also prove that their investment capital was lawfully sourced.<\/p>\n<p>Among the many forms documentation USCIS will require, there must be a comprehensive business plan with a hiring timetable and economic report and documents that prove the EB-5 investor has irrevocably committed their funds to the NCE, whether directly or into <a href=\"https:\/\/eb5affiliatenetwork.com\/trends-eb-5-escrow-agreements\/\" target=\"_blank\" rel=\"noopener\">an escrow account<\/a>. Such paperwork may include loan certificates, banks statements, promissory notes, or security agreements.
