They must go through consular processing in their home country.<br \/>\n<iframe src=\"https:\/\/www.youtube.com\/embed\/SOy9wr0bYL4?rel=0;&amp;autoplay=1&amp;mute=1&amp;loop=1&amp;\" width=\"100%\" height=\"678\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h3>Visa Waivers<\/h3>\n<p>The Visa Waiver Program (VWP) allows citizens of participating foreign countries to travel to the United States for tourism or business purposes without obtaining a visa. The visa waiver only covers stays in the United States for up to 90 days. If a foreign national wishes to stay in the United States for longer than that, they must obtain a visa.<\/p>\n<h3>Immigrant vs. Non-Immigrant Visas<\/h3>\n<p><img decoding=\"async\" src=\"https:\/\/eb5visainvestments.com\/wp-content\/uploads\/2023\/02\/FAQ-295_image-2.jpg\" \/><br \/>\nThere are two types of visas\u2014Immigrant and nonimmigrant. <a href=\"https:\/\/eb5affiliatenetwork.com\/us-immigrant-visas\/\" target=\"_blank\" rel=\"noopener\">Immigrant visas<\/a> demonstrate a foreign national\u2019s intention to make the United States their permanent residence. <a href=\"https:\/\/eb5affiliatenetwork.com\/nonimmigrant-visas\/\" target=\"_blank\" rel=\"noopener\">Non-immigrant visas<\/a>, on the other hand, are meant for only a specified period of time. Some nonimmigrant visas allow for dual intent, which means that applicants can enter the United States for one purpose\u2014to work or attend university, for example\u2014and then apply to adjust their status by filing Form I-485. This allows the applicant to remain in the United States while they apply for U.S. permanent resident status. Only certain nonimmigrant visas allow dual intent and it is in the applicant\u2019s best interest to <a href=\"https:\/\/eb5visainvestments.com\/2021\/12\/29\/finding-a-reliable-eb-5-immigration-attorney\/\" target=\"_blank\" rel=\"noopener\">work with an immigration attorney<\/a> to determine which is the best visa for their particular circumstances.<\/p>\n<h3>Concurrent Filing<\/h3>\n<p>Foreign nationals who participate in the <a href=\"https:\/\/eb5visainvestments.com\/abouteb5\/#process\" target=\"_blank\" rel=\"noopener\">EB-5 visa program<\/a> and are currently residing in the United States under a different visa\u2014H-1B, for example\u2014are eligible for concurrent filing. As a result of the <a href=\"https:\/\/eb5visainvestments.com\/2022\/08\/01\/eb-5-investors-now-enjoy-greater-chances-of-immigration-and-financial-success-under-the-new-eb-5-reform-and-integrity-act-of-2022\/\" target=\"_blank\" rel=\"noopener\">EB-5 Reform and Integrity Act of 2022<\/a>, EB-5 investors no longer have to wait for Form I-526E\u2014Immigrant Petition by Regional Center Investor\u2014to be adjudicated before they can adjust their status.
